Abstract
This study examines music copyright and efforts to provide partial welfare for music industry actors. Copyright infringement remains a growing issue, while music copyright is a fundamental right attached to its creator. Esping-Andersen’s Welfare State theory is used to analyze the state’s role in providing welfare, and Rogers M. Smith’s Citizenship theory examines how music industry actors construct citizenship. A qualitative phenomenological approach by Creswell is applied to interpret the state’s role in music copyright based on the experiences of industry actors. The results show that music copyright in Indonesia still faces significant challenges. Smith argues that fulfilling citizens’ rights, especially music copyright, is a process of negotiating inclusion and exclusion. In practice, efforts at inclusion through Law No. 28/2014 on Copyright are offset by exclusion due to unequal protection and royalty issues. Analysis from Esping-Andersen and Hegel’s perspectives reveals: 1) Lack of copyright socialization, so many industry actors do not fully understand their rights; 2) Limited knowledge of music copyright leads to stratification; and 3) Indonesia is a conservative regime, requiring state-private collaboration for welfare. | Additional Information: | Riset mengkaji hak cipta musik dan upaya memberikan kesejahteraan parsial kepada pelaku industri musik. Pelanggaran hak cipta menjadi polemik yang terus berkembang, hak cipta musik menjadi hak fundamental yang melekat pada penciptanya. Teori Welfare State Esping-Andersen digunakan untuk mengkaji peran negara dalam memberikan kesejahteraan dan teori Citizenship dari Rogers M. Smith digunakan untuk mengkaji konstruksi kewarganegaraan yang dilakukan pelaku industri musik. Metode kualitatif pendekatan fenomenologi ala Creswell digunakan untuk memaknai eksistensi negara dalam hak cipta musik berdasarkan pengalaman pelaku industri musik. Hasil penelitian menunjukkan hak cipta musik di Indonesia masih menghadapi berbagai tantangan. Smith berargumen pemenuhan hak warga negara khususnya hak cipta musik merupakan proses negosiasi antara inklusi dan eksklusi. Faktanya, upaya inklusi melalui UU No. 28 Tahun 2014 tentang Hak Cipta, terdapat eksklusi akibat ketidakmerataan perlindungan dan permasalahan royalti. Hasil analisis perspektif Esping-Andersen dan Hegel, persoalan hak cipta musik di Indonesia adalah: 1) Sosialisasi hak cipta kurang, sehingga banyak pelaku industri musik belum sepenuhnya memahami hak mereka; 2) Kurangnya pengetahuan mengenai hak cipta musik menyebabkan terjadinya stratifikasi; dan 3) Indonesia tergolong rezim konservatif, negara membutuhkan kolaborasi dengan swasta dalam memberikan kesejahteraan. Asertivitas negara sebagai regulator, fasilitator, dan pelindung hak cipta, fakta lapangan menunjukkan kesenjangan antara harapan dan implementasi. | ||||||
