Abstract
The rapid development of digital technology has driven the emergence of various creative content platforms, one of which is Webtoon. However, this advancement has also been accompanied by an increase in copyright infringements, particularly in the form of digital comic piracy through scanlation practices— namely, the unauthorized translation and distribution of works without the creator’s permission. This research aims to examine the legal protection afforded to creators against digital comic piracy on the Webtoon application, as well as the responsibilities of the relevant parties under Law Number 28 of 2014 concerning Copyright. The method used is normative juridical, employing statutory and literature approaches, and supported by interviews as primary data. The results of the study show that Law Number 28 of 2014 provides strong legal protection for the moral and economic rights of creators, both preventively and repressively. Responsibility for piracy does not rest solely with the distributors of pirated content, but may also extend to digital platforms and internet service providers who are negligent or complicit in facilitating such infringements. However, in practice, law enforcement still faces various challenges, such as low public legal awareness, weak oversight of digital platforms, and the ease with which illegal sites migrate to new domains. These conditions hinder the effectiveness of legal protection and the sustainability of creative works in the digital age.

| Additional Information: | Perkembangan teknologi digital yang pesat telah mendorong kemunculan berbagai platform konten kreatif, salah satunya Webtoon. Namun, kemajuan ini turut disertai dengan meningkatnya pelanggaran hak cipta, khususnya dalam bentuk pembajakan komik digital melalui praktik scanlation, yakni penerjemahan dan penyebarluasan karya tanpa izin dari pencipta. Penelitian ini bertujuan untuk mengetahui bagaimana bentuk perlindungan hukum terhadap pencipta atas pembajakan komik digital pada aplikasi Webtoon serta bagaimana tanggung jawab pihak terkait menurut UndangUndang Nomor 28 Tahun 2014 tentang Hak Cipta. Metode yang digunakan adalah yuridis normatif, dengan pendekatan perundang-undangan dan studi kepustakaan, serta didukung dengan wawancara sebagai data primer. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 28 Tahun 2014 telah memberikan perlindungan hukum yang kuat terhadap hak moral dan ekonomi pencipta, baik secara preventif maupun represif. Tanggung jawab atas pembajakan tidak hanya berada pada pelaku penyebaran karya bajakan, tetapi juga dapat melekat pada platform digital dan penyedia layanan internet yang lalai atau turut memfasilitasi pelanggaran tersebut. Namun, dalam praktiknya, penegakan hukum masih menghadapi berbagai tantangan seperti rendahnya kesadaran hukum masyarakat, lemahnya pengawasan terhadap platform digital, serta mudahnya situs ilegal bermigrasi ke domain baru. Kondisi ini menghambat efektivitas perlindungan hukum dan keberlanjutan karya kreatif di era digital. | |||||||||
