Abstract

Land acquisition for public interest often gives rise to conflicts between the government as the development implementer and the community as the land owner. One of the legal mechanisms available to resolve land ownership disputes in the land acquisition process is consignment, which is the deposit of compensation money in court in the event of a dispute or disagreement regarding the party entitled to receive compensation. This study aims to examine the suitability of the judge's considerations in determining compensation based on Law Number 2 of 2012 concerning Land Acquisition for Public Interest, and to analyze the possibility of combining a lawsuit for unlawful acts with a consignment application as regulated in Article 1365 of the Civil Code. Decision No. 596/Pdt.G/2023/PN Tng. This study shows that the judge's legal considerations in determining the right to compensation have taken into account valid evidence, witness statements, and the principle of legal certainty. In addition, the consignment mechanism has proven effective in ensuring the continuity of development projects despite ownership disputes. A lawsuit for unlawful acts can be filed simultaneously with a consignment application as a form of legal protection for the injured party. The results of this study are expected to contribute to strengthening the legal mechanisms for land acquisition for public purposes in Indonesia. This approach is crucial in maintaining the principle of legal certainty, as accepting objections without clear basis will create uncertainty and prolong conflicts, which could be detrimental to the public interest and development projects. Judges prioritize the principles of objectivity and proportionality in addressing these objections, ensuring that decisions are fair and equitable for all parties.

Additional Information: Pengadaan tanah untuk kepentingan umum seringkali menimbulkan konflik antara pemerintah sebagai pelaksana pembangunan dengan masyarakat sebagai pemilik lahan. Salah satu mekanisme hukum yang tersedia untuk menyelesaikan sengketa kepemilikan lahan dalam proses pengadaan tanah adalah konsinyasi, yaitu penitipan uang ganti rugi di pengadilan apabila terjadi sengketa atau ketidaksepakatan mengenai pihak yang berhak menerima ganti rugi. Penelitian ini bertujuan untuk mengkaji kesesuaian pertimbangan hakim dalam menentukan ganti rugi berdasarkan Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah untuk Kepentingan Umum, serta menganalisis kemungkinan penggabungan gugatan perbuatan melawan hukum dengan permohonan konsinyasi sebagaimana diatur dalam Pasal 1365 KUH Perdata. Putusan No. 596/Pdt.G/2023/PN Tng. Penelitian ini menunjukkan bahwa pertimbangan hukum hakim dalam menetapkan hak atas ganti rugi telah memperhatikan alat bukti sah, keterangan saksi, serta prinsip kepastian hukum. Selain itu, mekanisme konsinyasi terbukti efektif dalam menjamin kelangsungan proyek pembangunan meskipun terdapat sengketa kepemilikan. Gugatan perbuatan melawan hukum dapat diajukan bersamaan dengan permohonan konsinyasi sebagai bentuk perlindungan hukum terhadap pihak yang dirugikan. Hasil penelitian ini diharapkan dapat memberikan kontribusi terhadap penguatan mekanisme hukum dalam pengadaan tanah untuk kepentingan umum di Indonesia. Pendekatan ini sangat penting dalam menjaga prinsip kepastian hukum, karena menerima keberatan tanpa dasar yang jelas akan membuka celah ketidakpastian dan memperpanjang konflik yang justru merugikan kepentingan umum dan proyek pembangunan. Hakim mengedepankan asas obyektivitas dan proporsionalitas dalam menyikapi keberatan tersebut, sehingga putusan menjadi instrumen yang adil bagi semua pihak.
