Abstract
The determination of land transportation tariffs, especially for inter-city inter-province (AKAP) passenger transport in the economy class with public buses, is an important aspect in achieving affordable and equitable transportation. Problems arise because the tariff setting is inconsistent, resulting in many passengers feeling harmed by the buses in Banten Province, which is in violation of the regulations. The problem identification in this research is: What is the policy of the Banten Class II Land Transportation Management Center in setting land transportation tariffs (Buses) in Banten Province based on Ministerial Regulation Number 3 of 2023 concerning Basic Tariffs, Upper Limit Tariffs, and Lower Limit Tariffs for Inter-City Inter-Province Economy Class Passenger Transportation on Public Buses, in establishing public transport tariffs? And what obstacles does it face?. The theories used are the Theory of Authority and the Welfare State Theory. This research employs a juridical-empirical research method. The research specification used is descriptive-analytical. The data sources utilized in this study include primary and secondary data. The data collection technique applied in this research involves field research and literature review. The data analysis used in this research is based on a qualitative descriptive approach. The research findings indicate that the Class II Banten Transportation Management Center has carried out the tariff establishment process in accordance with the Minister of Transportation Regulation No. 3 of 2023 that is in effect, with a basic tariff data of Rp. 30,000, a Lower Limit Tariff of Rp. 45,000, and an Upper Limit Tariff of Rp. 55,000, the base tariff, upper limit tariff, and lower limit tariff are regulated in Article 1 subsection a, which states: The Base Tariff is the tariff calculated per passenger kilometer expresses in rupiah. The upper limit tariff and the lower tariff in Article 1 subsections b and c have been established by the minister through the Director General Of Land Transportation. There are still several obstacles in the field, such as coordination among stakeholders and socialization to operators and the public. This research recommends enhancing crosssector coordination and strengthening the perodic evaluation mechanism of tariffs to ensure that policy implementation is effective and in favor of public interests.

Permasalahan muncul karena penetapan tarif tidak sesuai sehingga banyak penumpang merasa di rugikan oleh Bus di Provinsi Banten , hal ini bertentangan dengan peraturan perundang-undangan. Identifikasi masalah dalam penelitian ini adalah Bagaimana kebijakan Balai Pengelola Transportasi Darat Kelas II Banten dalam Penetapan Tarif Transportasi Darat (Bus) di Provinsi Banten berdasarkan Peraturan Menteri Nomor 3 Tahun 2023 tentang Tarif Dasar, Tarif Batas Atas Dan Tarif Batas Bawah Angkutan Penumpang Antarkota Antarprovinsi Kelas Ekonomi Di Jalan Dengan Mobil Bus Umum, dalam menetapkan tarif transportasi umum? Dan bagaimana hambatan yang di hadapinya?. Teori yang digunakan ialah Teori Kewenangan dan Teori Negara Kesejahteraan. Penelitian ini menggunakan metode penelitian yuridis empiris. Spesifikasi penelitian yang digunakan adalah deskriptif analitis. Sumber data penelitian yang digunakan berupa data primer dan sekunder. Teknik pengumpulan data pada penelitian ini menggunakan teknik penelitian lapangan, penelitian kepustakaan. Analisis data pada penelitian yang digunakan berupa pendeketan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa BPTD Kelas II Banten telah melaksanakan proses penetapan tarif sesuai dengan Peraturan Menteri Perhubungan Nomor 3 Tahun 2023 yang berlaku, dengan data tarif dasar sebesar Rp. 30.000, Tarif Batas Bawah Rp. 45.000, dan Tarif Batas Atas 55.000, tarif dasar, tarif batas atas dan tarif batas bawah diatur dalam Pasal 1 huruf a, yaitu: Tarif Dasar adalah Tarif yang dihitung per penumpang kilometer yang dinyatakan dalam bentuk rupiah. Dan, Tarif batas atas dan Tarif Batas Bawah dalam Pasal 1 huruf b dan c, telah ditetapkan oleh Menteri melalui Direktur Jenderal Perhubungan Darat. Hal ini masih terdapat beberapa hambatan di lapangan, seperti koordinasi antar pemangku kepentingan dan sosialisasi kepada operator serta masyarakat. Penelitian ini merekomendasikan peningkatan koordinasi lintas sektor dan penguatan mekanisme evaluasi tarif secara periodik untuk memastikan penerapan kebijakan berjalan efektif dan berpihak pada kepentingan publik. | |||||||||
