Abstract
Outsourcing problems that are not in accordance with the rules have an impact on the welfare of the community, so legal protection for labor in Indonesia is very important. Legal protection of workers is regulated in Government Regulation Number 35 of 2021 concerning Fixed-Term Employment Agreements, Outsourcing, Working Time and Rest Time, and Termination of Employment, this is confirmed in Article 11 paragraph (3) of Government Regulation Number 35 of 2021 which reads “Employers as referred to in paragraph (1) are obliged to fulfill the rights of workers or laborers including the right to a social security program”. The problem identification in this study is how legal protection and protection barriers to outsourced labor of PT Swadec Security Service at Sultan Ageng Tirtayasa University. The theories used are legal protection theory and welfare state theory. The research method used is empirical juridical with qualitative research type and descriptive. The research shows that Soerjono Soekanto identified five law enforcement factors, including culture. However, the outsourced workers of PT Swadec Security Service face problems such as inactive BPJS, wages below the minimum wage, and working hours not according to the rules, indicating that legal protection has not been realized due to the default of the legal structure, where the rights of workers have not been fully fulfilled. The 1945 Constitution mandates the objectives of a welfare state, including public management of resources, fair distribution of wealth, poverty reduction, and social protection. However, the outsourced workers of PT Swadec Security Service face obstacles, such as weak regulations, lack of company awareness, differences in the position of workers and companies, and unfulfilled worker rights. These obstacles show that the welfare state theory has not been fully realized for outsourced workers at Sultan Ageng Tirtayasa University. The conclusion is that the occurrence of legal structure defaults related to workers' rights such as BPJS, wages below the minimum wage and working hours not in accordance with the rules shows that legal protection is still not comprehensive. The incompatibility of the principle of the welfare state with its implementation can be seen from the unfulfilled rights of PT Swadec Security Service workers, creating a gap in the protection of outsourced labor.

Perlindungan hukum terhadap pekerja diatur dalam Peraturan Pemerintah Nomor 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat, dan Pemutusan Hubungan Kerja, hal ini ditegaskan dalam Pasal 11 ayat (3) Peraturan Pemerintah Nomor 35 Tahun 2021 yang berbunyi “Pengusaha sebagaimana dimaksud pada ayat (1) wajib memenuhi hak-hak pekerja atau buruh termasuk hak atas program jaminan sosial”. Identifikasi masalah dalam penelitian ini adalah bagaimana perlindungan hukum dan hambatan perlindungan terhadap tenaga kerja outsourcing PT. Swadec Security Service yang ada di Universitas Sultan Ageng Tirtayasa. Teori yang digunakan ialah teori perlindungan hukum dan teori negara kesejahteraan. Metode penelitian yang digunakan adalah yuridis empiris dengan jenis penelitian kualitatif dan bersifat deskriptif. Penelitian menunjukkan bahwa Soerjono Soekanto mengidentifikasi lima faktor penegakan hukum, termasuk kebudayaan. Namun, tenaga kerja outsourcing PT. Swadec Security Service menghadapi masalah seperti BPJS tidak aktif, upah di bawah UMK, dan jam kerja tidak sesuai aturan, menunjukkan perlindungan hukum belum terealisasi akibat wanprestasi struktur hukum, yang dimana hak-hak tenaga kerja belum sepenuhnya terpenuhi. UUD 1945 mengamanatkan tujuan negara kesejahteraan, termasuk pengelolaan sumber daya untuk publik, distribusi kekayaan adil, pengurangan kemiskinan, dan proteksi sosial. Namun, tenaga kerja outsourcing PT. Swadec Security Service menghadapi hambatan, seperti regulasi yang lemah, kurangnya kesadaran perusahaan, perbedaan kedudukan pekerja dan perusahaan, serta hak pekerja yang belum terpenuhi. Hambatan ini menunjukkan teori negara kesejahteraan belum sepenuhnya terwujud bagi pekerja outsourcing di Universitas Sultan Ageng Tirtayasa. Kesimpulannya adalah terjadinya wanprestasi struktur hukum terkait dengan hak pekerja seperti BPJS, upah di bawah UMK dan jam kerja tidak sesuai aturan menunjukkan perlindungan hukum masih kurang komprehensif. Ketidaksesuaian prinsip negara kesejahteraan dengan implementasinya terlihat dari hak pekerja PT. Swadec Security Service yang belum terpenuhi, menciptakan kesenjangan perlindungan tenaga kerja outsourcing. | |||||||||
