Abstract
The Cultural Heritage Preservation Center for Region VIII (Balai Pelestarian Kebudayaan Wilayah VIII) plays a key role in the preservation of cultural heritage sites in Banten and the Special Capital Region of Jakarta (DKI Jakarta). In the revitalization of the Banten Lama area, differences in perspective arose between the local government and Region VIII’s Cultural Heritage Preservation Center, particularly regarding the addition of new elements considered to compromise the authenticity of the mosque.The research problem identified in this study is how the authority of Region VIII’s Cultural Heritage Preservation Center is exercised in the preservation of the Great Mosque of Banten as a cultural heritage site, and what considerations underlie its decisions regarding revitalization within the Banten Lama cultural heritage area. The theoretical framework is based on the theory of authority and the theory of legal protection. The research uses an empirical juridical method, with a qualitative descriptive approach.The findings of this study indicate that the Cultural Heritage Preservation Center for Region VIII has exercised its authority in the preservation of the Great Mosque of Banten in accordance with Article 72 of Law Number 11 of 2010 on Cultural Heritage, as well as Ministry of Education, Culture, Research, and Technology Regulation Number 33 of 2022, which serves as a derivative regulation of the aforementioned law. All policies, including those related to revitalization, must be aligned with preservation principles established by law.The revitalization process carried out by the local government, in coordination with the Cultural Heritage Preservation Center for Region VIII, has led to differing views— particularly concerning the introduction of new architectural elements perceived to diminish the mosque’s authenticity. The implementation of preservation efforts is conducted through a strict permitting mechanism that takes into account safety, maintenance, and adherence to preservation principles.In conclusion, the Cultural Heritage Preservation Center for Region VIII carries out its duties in coordination with various stakeholders, including during the revitalization of the Great Mosque of Banten. However, the process faces numerous challenges, such as differences in opinion and interpretation among involved parties.

Identifikasi masalah dalam penelitian ini adalah bagaimana pelaksanaan kewenangan BPK Wilayah VIII dalam pelestarian Masjid Agung Banten Lama sebagai cagar budaya Banten Lama dan apa dasar dasar pertimbangan BPK Wilayah VIII dalam revitalisasi dikawasan cagar budaya Masjid Agung Banten Lama. Teori yang digunakan adalah teori kewenangan dan teori perlindungan hukum. Metode penelitian yang digunakan adalah metode yuridis empiris, dengan jenis penelitian deskriptif kualitatif. Hasil dari penelitinan menunjukan bahwa Balai Pelestarian Kebudayaan Wilayah VIII telah melaksanakan kewenangan dalam pelestarian cagar budaya Masjid Agung Banten mengacu pada pasal 72 Undang-undang Nomor 11 Tahun 2010 tentang cagar budaya serta Permendikbudristek No. 33 Tahun 2022 sebagai turunan dari UU tersebut. Segala kebijakan, termasuk revitalisasi, harus mengacu pada prinsip pelestarian yang ditetapkan dalam undang-undang. Proses revitalisasi yang dilakukan pemerintah daerah dengan koordinasi Balai Pelestarian Kebudayaan Wilayah VIII juga menimbulkan perbedaan pandangan, terutama terkait penambahan elemen baru yang dinilai dapat mengurangi keaslian masjid. Dalam pelaksanaan pelestarian itu dilakukan melalui mekanisme perizinan yang sangat ketat dan mempertimbangkan keamanan, keterawatan, serta prinsip-prinsip pelestarian. Kesimpulan dari penelitian ini adalah dalam mejalanan tugasnya Balai Pelestarian Kebudayaan Wilayah VIII berkoordinasi dengan beberapa pihak seperti halnya dalam revitalisasi yang terjadi pada Masjid Agung Banten Lama, namun dalam prosesnya banyak kendala yang dihadapi, seperti perbadaan pendapat. | |||||||||
