Abstract
This research is motivated by the problem of the increasing number of motorized vehicles in Serang City which has a negative impact on air quality. The government has issued Regulation of the Minister of Environment and Forestry of the Republic of Indonesia Number 8 of 2023 as a legal substance, but in its implementation the public is not yet aware of the obligations issued by the regulation. The identification of the problem of this study is how the implementation of the authority of the Serang City Environmental Service regarding air pollution control due to motor vehicle exhaust emissions is reviewed based on the Regulation of the Minister of Environment and Forestry of the Republic of Indonesia Number 8 of 2023, and what obstacles are faced in implementing its authority. The theories used are the theory of authority and the theory of law enforcement. The research method uses an empirical juridical approach. The data sources used are primary data and secondary data. Data collection techniques are carried out through literature studies and field studies. Data are analyzed using a qualitative approach. The results of the study indicate that the Serang City Environmental Service has fulfilled the attribution authority, delegation authority and mandate as stated by Philipus M. Hadjon's theory there are three types of authority, however in its implementation the Serang City Environmental Service still has shortcomings, the first deficiency can be seen through the Legal Structure and the second is the Legal Culture as stated by Lawrence M. Friedman's theory law enforcement is influenced by three main elements. These shortcomings can be caused by several obstacles felt by the Serang City Environmental Service, ranging from a less than optimal budget to a lack of human resources certified by the National Professional Certification Council (DNSP).

Pemerintah telah mengeluarkan Peraturan Menteri Lingkungan Hidup dan Kehutanan Republik Indonesia Nomor 8 Tahun 2023 sebagai substansi hukum, namun dalam pelaksanaannya masyarakat belum mengetahui terkait adanya kewajiban yang dikeluarkan oleh peraturan tersebut. Identifikasi masalah dari penelitian ini adalah bagaimana pelaksanaan kewenangan Dinas Lingkungan Hidup Kota Serang terhadap pengendalian pencemaran udara akibat emisi gas buang kendaraan bermotor ditinjau berdasarkan Peraturan Menteri Lingkungan Hidup Kota Serang terhadap pengendalian pencemaran udara akibat emisi gas buang kendaraan bermotor ditinjau berdasarkan Peraturan Menteri Lingkungan Hidup dan Kehutanan Republik Indonesia Nomor 8 Tahun 2023, serta bagaimana hambatan yang dihadapi dalam pelaksanaan kewenangannya. Teori yang digunakan adalah teori kewenangan dan teori penegakan hukum. Metode penelitian menggunakan pendekatan yuridis empiris. Sumber data yang digunakan adalah data primer dan data sekunder. Teknik pengumpulan data dilakukan melalui studi kepustakaan dan studi lapangan. Data dianalisis menggunakan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa Dinas Lingkungan Hidup Kota Serang telah memenuhi kewenangan atribusi, kewenangan delegasi dan mandat, namun dalam pelaksanaannya Dinas Lingkungan Hidup Kota Serang masih mempunyai kekurangan, kekurangan pertama dapat dilihat melalui Struktur Hukum dibuktikan dengan tidak ada pemberitahuan dari Dinas Lingkungan Hidup Kota Serang bahwa pengujian emisi menjadi syarat administratif pembayaran pajak dan yang kedua adalah Budaya Hukum ditujukan dengan tidak adanya kesadaran hukum atau inisiatif dari masyarakat untuk mencari tahu dan melaksanakan uji emisi berkala secara mandiri. Kekurangan tersebut dapat disebabkan oleh beberapa hambatan yang dirasakan oleh Dinas Lingkungan Hidup Kota Serang, mulai dari anggaran yang belum optimal hingga kurangnya sumberdaya manusia yang bersertifikat Dewan Nasional Sertifikasi Profesi (DNSP). | |||||||||
