Abstract
The development of digital technology has had a significant impact in various sectors, including the entertainment industry. One of the negative impacts that has arisen is the increase in copyright infringement in the distribution of films through social media platforms, especially TikTok. Films that have just been shown in theaters are often illegally recorded and disseminated by irresponsible individuals, ultimately harming the film industry and copyright owners. Based on Law Number 28 of 2014 concerning Copyright, this action is classified as a violation of the economic rights and moral rights of creators. This study aims to find out the legal protection of films in cinemas recorded and disseminated through TikTok and to find out the legal consequences of infringement of film recordings in cinemas disseminated through TikTok based on Law Number 28 of 2014 concerning Copyright. The theories used in this study are legal protection theory and reward theory. The method used in this study is normative juridical with a conceptual and legislative approach. The data sources used are secondary data sources through books, documents, journals, laws and regulations and primary data sources through interviews. The data collection techniques of this research are literature studies and field studies. In addition, this study also uses qualitative descriptive analysis to describe the phenomenon of film piracy in cinemas and the role of digital platforms in disseminating illegal content. The results of the study show that although Law Number 28 of 2014 has provided legal protection for film copyright, its implementation still faces various challenges. TikTok has provided a mechanism for removing content that infringes copyright, but pirates can still circumvent the moderation system in various ways. In addition, weak law enforcement in Indonesia causes a lack of deterrent effects for perpetrators. Therefore, concrete steps are needed in the form of cooperation between the government, copyright owners, and digital platforms to increase the effectiveness of legal protection and ensure strict sanctions for violators to prevent widespread piracy practices.

| Additional Information: | Perkembangan teknologi digital telah membawa dampak signifikan dalam berbagai sektor, termasuk industri hiburan. Salah satu dampak negatif yang muncul adalah meningkatnya pelanggaran hak cipta dalam distribusi film melalui platform media sosial, khususnya TikTok. Film yang baru tayang di bioskop sering kali direkam dan disebarluaskan secara ilegal oleh individu yang tidak bertanggung jawab, yang pada akhirnya merugikan industri perfilman dan pemilik hak cipta. Berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, tindakan ini tergolong sebagai pelanggaran hak ekonomi dan hak moral pencipta. Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap film di bioskop yang direkam dan disebarluaskan melalui TikTok serta untuk mengetahui akibat hukum terhadap tindakan pelanggaran perekaman film di bioskop yang disebarluaskan melalui TikTok berdasarkan Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Teori yang digunakan pada penelitian ini adalah teori perlindungan hukum dan teori penghargaan. Metode yang digunakan pada penelitian ini adalah yuridis normatif dengan pendekatan konseptual dan perundang-undangan. Sumber data yang digunakan adalah sumber data sekunder melalui buku, dokumen, jurnal, peraturan perundang-undangan dan sumber data primer melalui wawancara. Teknik pengumpulan data penelitian ini adalah studi kepustakaan dan studi lapangan. Selain itu, penelitian ini juga menggunakan analisis deskriptif kualitatif untuk menggambarkan fenomena pembajakan film di bioskop dan peran platform digital dalam menyebarluaskan konten ilegal. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Nomor 28 Tahun 2014 telah memberikan perlindungan hukum terhadap hak cipta film, implementasinya masih menghadapi berbagai tantangan. TikTok telah menyediakan mekanisme penghapusan konten yang melanggar hak cipta, namun pelaku pembajakan masih dapat menghindari sistem moderasi dengan berbagai cara. Selain itu, lemahnya penegakan hukum di Indonesia menyebabkan kurangnya efek jera bagi pelaku. Oleh karena itu, diperlukan langkah konkret berupa kerja sama antara pemerintah, pemilik hak cipta, dan platform digital guna meningkatkan efektivitas perlindungan hukum serta memastikan sanksi tegas bagi pelanggar guna mencegah praktik pembajakan yang semakin meluas. | |||||||||
