Abstract
This research aims to analyze the division of inheritance for adopted children in the Baduy Luar community and its legal implications based on the Compilation of Islamic Law. The study uses a qualitative method with a case study approach in Kanekes Village, Leuwidamar District, Lebak Regency, Banten. The problem identification in this study is: How is the inheritance division for adopted children in the Baduy Luar community and the Compilation of Islamic Law? What are the legal implications regarding the inheritance division for adopted children in the Baduy Luar community? The research findings show that adopted children, known as 'anak pulung,' receive an equal portion to biological children in inheritance division. The Baduy community considers adopted children as an integral part of the family, thus their inheritance rights are highly valued.This research also found that the process of inheritance distribution is carried out collectively by the family after the heir's death, with the presence of involved family members. The juridical aspect of inheritance distribution for adopted children within the framework of Islamic law adopted by the Baduy community shows that although the concept of inheritance law is based on official charters, arrangements in the context of customary law are still very strong. Therefore, there is a need for reinforcement and understanding of the rights of adopted children in the context of inheritance, as well as the importance of clear documentation of those rights to protect the interests of adopted children in society. This research is expected to contribute to the development of legal science, especially regarding inheritance law in indigenous communities and its adjustment to current applicable laws.

| Additional Information: | Penelitian ini bertujuan untuk menganalisis pembagian harta waris bagi anak angkat pada masyarakat Baduy Luar serta implikasi hukum yuridisnya berdasarkan Kompilasi Hukum Islam. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus di Desa Kanekes, Kecamatan Leuwidamar, Kabupaten Lebak, Banten. Adapun identifikasi masalah dalam penelitian ini adalah Bagaimana pembagian waris bagi anak angkat pada masyarakat Baduy Luar dan kompilasi Hukum Islam, Bagaimana akibat hukum yuridis terhadap pembagian waris bagi anak angkat pada masyarakat Baduy Luar. Hasil penelitian menunjukkan bahwa anak angkat, yang dikenal dengan istilah "anak pulung," mendapatkan porsi yang setara dengan anak kandung dalam hal pembagian waris. Masyarakat Baduy menganggap anak angkat sebagai bagian integral dari keluarga, sehingga haknya dalam pewarisan sangat dihargai. Penelitian ini juga menemukan bahwa proses pembagian harta waris dilakukan secara kolektif oleh keluarga setelah pewaris meninggal, dengan kehadiran anggota keluarga yang terlibat. Sisi yuridis dari pembagian waris bagi anak angkat dalam kerangka hukum Islam yang diadopsi oleh masyarakat Baduy menunjukkan bahwa meskipun konsep hukum waris berlandaskan pada piagam resmi, pengaturan dalam konteks adat masih sangat lekat. Dengan demikian, perlu adanya penguatan dan pemahaman tentang hak anak angkat dalam konteks waris, serta pentingnya dokumentasi yang jelas dari hak-hak tersebut agar dapat melindungi kepentingan anak angkat dalam masyarakat. Penelitian ini diharapkan dapat memberikan kontribusi pada perkembangan ilmu hukum, khususnya mengenai kewarisan hukum dalam masyarakat adat dan penyesuaian terhadap hukum yang berlaku saat ini. | |||||||||
