Abstract
Additional Protocol I of 1977 has prohibited the use of white phosphorus in armed conflict although not explicitly. However, white phosphorus, as an incendiary weapon used in the Gaza Refugee Camp is very much against the principle of distinction in Additional Protocol I of 1977, which regulates the prohibition of its use against civilians. The problems are; First, how is the regulation of the use of White Phosphorus in armed conflict according to the 1977 Additional Protocol I on International Conflict? Second, How is the implementation of the 1977 Additional Protocol I on International Conflict against the use of White Phosphorus in the Gaza Refugee Camp by Israel? This research uses normative juridical method with juridical qualitative analysis of legal documents and relevant literature, and is based on the theory of justice and the principle of distinction. The results of the research: First, Regulations related to the use of white phosphorus have been regulated in Article 35 Paragraph (2), Article 48, Article 51, and Article 52 of Additional Protocol I of 1977, Second, Although Israel is not a party to Additional Protocol I of 1977, its principles that have become customary international law remain binding, but enforcement against violations such as the use of white phosphorus in Gaza faces legal and political obstacles, mainly due to diplomatic support and veto from Israel's allies.

| Additional Information: | Protokol Tambahan I Tahun 1977 telah melarang penggunaan fosfor putih dalam konflik bersenjata walau tidak secara eksplisit. Namun, fosfor putih, sebagai senjata pembakar yang penggunaannya di Kamp Pengungsi Gaza sangat bertentangan dengan prinsip pembedaan dalam Protokol Tambahan I Tahun 1977, yang mengatur larangan penggunaannya terhadap warga sipil. Masalahannya adalah; Pertama, bagaimana pengaturan penggunaan Fosfor Putih dalam konflik bersenjata menurut Protokol Tambahan I Tahun 1977 tentang Konflik Internasional? Kedua, Bagaimana implementasi Protokol Tambahan I Tahun 1977 tentang Konflik Internasional terhadap penggunaan Fosfor Putih di Kamp Pengungsi Gaza oleh Israel?. Penelitian ini menggunakan metode yuridis normatif dengan analisis kualitatif yuridis terhadap dokumen hukum dan literatur yang relevan, serta didasarkan pada teori keadilan dan prinsip pembedaan. Adapun hasil penelitian: Pertama, Pengaturan terkait dengan Penggunaan fosfor putih telah diatur dalam Pasal 35 Ayat (2), Pasal 48, Pasal 51, serta Pasal 52 Protokol Tambahan I Tahun 1977, Kedua, Meskipun Israel bukan pihak dalam Protokol Tambahan I Tahun 1977, prinsip-prinsipnya yang telah menjadi hukum kebiasaan internasional tetap mengikat, namun penegakan terhadap pelanggaran seperti penggunaan fosfor putih di Gaza menghadapi hambatan hukum dan politik, terutama karena dukungan diplomatik dan veto dari sekutu Israel. | |||||||||
