Abstract
The use of plastic bags without any reduction causes climate change and an increase in the volume of waste at the Cilowong TPA by 2.5% per month, Article 4 paragraph (2) of the Regulation of the Minister of Environment and Forestry Number 75 of 2019 states that plastic products, product packaging, and/or containers are materials that are difficult to decompose by natural processes and cannot be recycled. The identification of the problem is, How is the implementation of the authority and obstacles to the implementation of the authority of the Serang City Environmental Service in reducing the use of singleuse plastic bags based on the Regulation of the Minister of Environment and Forestry Number 75 of 2019 concerning the Roadmap for Waste Reduction by Producers. The theories used include the theory of authority and the welfare state. This study uses an empirical legal method with an analytical descriptive approach. Data were obtained through interviews with Young Expert Environmental Extension Workers of the Serang City Environmental Service and the Serang City community. The results of the study were that the Serang City Environmental Service in the field of waste management and toxic and hazardous materials had made efforts to reduce the use of single-use plastic bags but were not implemented optimally. The results of the study show that the Serang City Environmental Service is a source of delegated authority from the Mayor of Serang through the Serang Mayor Regulation Number 13 of 2021 concerning the Position, Organizational Structure, Duties and Functions and Work Procedures of the Serang City Environmental Service with regulatory and educational authority. Obstacles to the Serang City Environmental Service in Reducing the Use of Single-Use Plastic Bags include, Implementation of Suboptimal Supervision in the theory of the welfare state requires the allocation of regional funds for CCTV operational costs as supervision with a more efficient budget, Difficulty in Socializing the Implementation of Reducing Single-Use Plastic Bags by providing environmentally friendly shopping bags in traditional markets can balance the goal of reducing plastic with social justice and support the sustainability of vulnerable groups, and Lack of Understanding of the Serang City Environmental Service Regarding Single-Use Plastic Bags the need to increase institutional capacity, understanding of regulations, and strengthening coordination between institutions.

Adapun identifikasi masalahnya, Bagaimana pelaksanaan kewenangan dan Hambatan Pelaksanaan Kewenangan Dinas Lingkungan Hidup Kota Serang dalam pengurangan penggunaan kantong plastik sekali pakai berdasarkan Peraturan Menteri Lingkungan Hidup dan Kehutanan Nomor 75 Tahun 2019 tentang Peta Jalan Pengurangan Sampah Oleh Produsen?. Teori yang digunakan meliputi teori kewenangan dan negara kesejahteraan. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan deskriptif analitis. Data diperoleh melalui wawancara dengan Penyuluh Lingkungan Hidup Ahli Muda Dinas Lingkungan Hidup Kota Serang dan masyarakat Kota Serang. Hasil penelitian yang didapat adalah Dinas Lingkungan Hidup Kota Serang bidang pengelolaan sampah dan bahan berbahaya beracun telah berupaya menjalankan Pengurangan Penggunaan Kantong Plastik Sekali Pakai tidak terlaksana dengan optimal. Hasil penelitian menunjukkan Dinas Lingkungan Hidup Kota Serang merupakan sumber kewenangan delegasi dari Walikota Serang melalui Peraturan Walikota Serang Nomor 13 Tahun 2021 tentang Kedudukan, Susunan Organisasi, Tugas Dan Fungsi Serta Tata Kerja Dinas Lingkungan Hidup Kota Serang dengan memiliki kewenangan regulasi dan edukasi. Hambatan Dinas Lingkungan Hidup Kota Serang dalam Pengurangan Penggunaan Kantong Plastik Sekali Pakai antara lain, Penerapan Pengawasan Tidak Maksimal dalam teori negara kesejahteraan memerlukan alokasi dana daerah untuk biaya operasional cctv sebagai pengawasan dengan anggaran yang lebih efisien, Sulitnya Sosialisasi Penerapan Pengurangan Kantong Plastik Sekali Pakai dengan penyediaan kantong belanja yang ramah lingkungan di pasar tradisional dapat menyeimbangkan tujuan pengurangan plastik dengan keadilan sosial serta mendukung keberlanjutan kelompok rentan, dan Ketidakpahaman Dinas Lingkungan Hidup Kota Serang Tentang Kantong Plastik Sekali Pakai perlunya peningkatan kapasitas kelembagaan, pemahaman terhadap regulasi, serta penguatan koordinasi antar lembaga. | |||||||||
