Abstract
This research discusses criminal law protection for victims of wrongful arrest, particularly in cases of caused by Abuse of Power by police officers. The case study focuses on Pegi Setiawan, who was wrongly arrested by the West Java Police in connection with the murder of Vina and Eky in 2016. The research uses the theory of Legal Protection and Criminal Law, and compares similar cases such as the wrongful arrest of Subur, Titin, and Supriyani. The research method used is normative with descriptive analysis based on laws and regulations. The results show that Pegi Setiawan has not received compensation or restoration of good name from the West Java Police, in contrast to Supriyani's case who received restoration of good name although she has not received compensation. In addition, police officers involved in Pegi's wrongful arrest did not receive adequate sanctions, in contrast to the cases of Subur and Titin where the perpetrators of wrongful arrest received removal sanctions.

| Additional Information: | Penelitian ini membahas perlindungan hukum pidana bagi korban salah tangkap, khususnya dalam kasus yang disebabkan oleh Abuse of Power oleh aparat kepolisian. Studi kasus difokuskan pada Pegi Setiawan, yang salah ditangkap oleh Kepolisian Polda Jawa Barat terkait kasus pembunuhan Vina dan Eky pada 2016. Penelitian menggunakan teori Perlindungan Hukum dan Hukum Pidana yang mengutamakan pada hukum pidana merupakan 2 sisi dari koin yang sama, satu sisi hukum pidana memberikan perlindungan hukum, satu sisi hukum pidana memberikan hukuman, serta membandingkan kasus serupa seperti salah tangkap Subur, Titin, dan Supriyani. Metode penelitian yang digunakan adalah normatif dengan analisis deskriptif berdasarkan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa Pegi Setiawan belum menerima ganti rugi atau pemulihan nama baik dari Polda Jawa Barat, berbeda dengan kasus Supriyani yang mendapatkan pemulihan nama baik meski belum mendapat ganti rugi. Selain itu, anggota kepolisian yang terlibat dalam salah tangkap Pegi tidak mendapatkan sanksi yang memadai, berbeda dengan kasus Subur dan Titin di mana pelaku salah tangkap mendapatkan sanksi pencopotan. | |||||||||
