Abstract
Violations of Human Rights (HAM) that occurred in Wadas Village were based on the residents' concerns that mining activities would damage the local ecosystem. The repressive actions of law enforcement, which included the use of tear gas and the arrest of 67 residents, including one legal aid companion from LBH Yogyakarta, constitute a violation of Human Rights (HAM). Based on this case, research was conducted to understand and explain the forms of repressive actions by law enforcement and their impact on Human Rights (HAM), as well as to determine the criminal legal protection that should be received by the residents of Wadas Village. This research uses a normative juridical method with a qualitative approach. This study also utilizes primary data sources and secondary data sources as the main data, which consist of primary legal materials, secondary legal materials, and tertiary legal materials. Through analysis of human rights theory, this repressive action is contrary to the provisions of Law Number 2 of 2002 concerning the Indonesian National Police, Regulation of the Indonesian National Police Chief Number 8 of 2009 concerning the Implementation of Human Rights Principles and Standards, the Criminal Procedure Code, and violates Law Number 39 of 1999 concerning Human Rights, as well as Law Number 26 of 2000. The implementation of criminal legal protection is carried out by LBH Yogyakarta and the National Commission on Human Rights of the Republic of Indonesia as legal advisors for citizens and seeks compensation for 143 land ownerships that have been released by the Serayu Opak River Basin Organization (BBWSSO). Therefore, the researchers recommend that the government establish an independent team to investigate the violence of the authorities and ensure a fair legal process for the victims, as well as strengthen oversight and accountability mechanisms for the authorities to prevent arbitrary practices from recurring and maintain public trust in the law.

Additional Information: | Pelanggaran Hak Asasi Manusia (HAM) yang terjadi di Desa Wadas didasari oleh kekhawatiran warga kegiatan penambangan akan merusak ekosistem lokal. Tindakan represifitas aparat kepolisian yang menggunakan gas air mata dan menangkap 67 warga termasuk salah satu pendamping hukum dari LBH Yogyakarta merupakan pelanggaran Hak Asasi Manusia (HAM). Berdasarkan kasus tersebut, penelitian dilakukan untuk mengetahui dan menjelaskan bentuk tindakan represifitas oleh aparat kepolisian memberikan dampak terhadap Hak Asasi Manusia (HAM) dan mengetahui perlindungan hukum pidana yang seharusnya diperoleh bagi warga Desa Wadas. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kualitatif. Penelitian ini juga menggunakan sumber data primer dan sumber data sekunder sebagai data utama yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Melalui analisis terhadap teori HAM, tindakan represif ini bertentangan dengan ketentuan Undang-undang Nomor 2 Tahun 2002 tentang Kepolisian Negara Republik Indonesia, Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2009 tentang Implementasi Prinsip dan Standar Hak Asasi Manusia (HAM), Kitab Undang-undang Hukum Acara Pidana, dan melanggar Undang-undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia (HAM), serta Undang-undang nomor 26 Tahun 2000 dan implementasi perlindungan hukum pidana dilakukan oleh LBH Yogyakarta dan Komnas HAM RI sebagai pendamping hukum warga dan mengupayakan ganti rugi 143 kepemilikan lahan yang telah dibebaskan oleh Balai Besar Wilayah Sungai Serayu Opak (BBWSSO). Oleh karena itu, peneliti menyarankan agar pemerintah membentuk tim independen untuk menyelidiki kekerasan aparat dan menjamin proses hukum yang adil bagi korban, serta memperkuat mekanisme pengawasan dan pertanggungjawaban aparat agar praktik sewenang-wenang tidak terulang dan kepercayaan terhadap hukum tetap terjaga. | |||||||||
