Abstract
The implementation of compensation in the case of land seizure by the Serang City Government for public interest purposes, based on the Supreme Court Review Decision Number 626 PK/PDT/2023. The background of this study stems from the conflict between development needs and the protection of individual land ownership rights. The aim of the research is to analyze the compliance of compensation implementation with the principles of good governance and its impact on public trust. The method employed is an empirical juridical approach with descriptive-analytical techniques. The findings reveal that the compensation implementation does not fully reflect the principles of accountability, transparency, and substantive justice. The compensation set at five times the Tax Object Sale Value (NJOP) does not correspond to the actual market value of the land, indicating a gap between legal norms and administrative practices in the field. Moreover, the lack of community participation and delays in executing court decisions have weakened public trust in the government. The discrepancy between the compensation value and market value also negatively impacts the economic rights of landowners, causing material losses and undermining government legitimacy. The absence of transparency, accountability, and responsiveness shows that the principles of good governance have not been effectively applied, potentially escalating future social conflicts.

| Additional Information: | Implementasi ganti rugi dalam kasus penyerobotan tanah oleh Pemerintah Kota Serang untuk kepentingan umum, berdasarkan studi Putusan Peninjauan Kembali Nomor 626 PK/PDT/2023. Latar belakang penelitian ini adalah konflik antara kebutuhan pembangunan dan perlindungan hak milik warga. Tujuan penelitian ini untuk menganalisis kesesuaian implementasi ganti rugi dengan prinsip good governance serta dampaknya terhadap kepercayaan publik. Metode yang digunakan adalah yuridis empiris dengan pendekatan deskriptif analitis. Hasil penelitian menunjukkan bahwa implementasi ganti rugi belum mencerminkan prinsip akuntabilitas, transparansi, dan keadilan substantif. Besaran ganti rugi sebesar lima kali NJOP tidak sesuai dengan nilai pasar aktual tanah, yang mencerminkan adanya ketimpangan antara norma hukum dan praktik administrasi di lapangan. Selain itu, proses yang minim partisipasi warga dan keterlambatan eksekusi putusan melemahkan kepercayaan publik terhadap pemerintah. Ketidaksesuaian nilai ganti rugi juga berdampak negatif terhadap hak ekonomi pemilik tanah, menimbulkan kerugian materiil dan memperburuk legitimasi pemerintah. Kurangnya transparansi, akuntabilitas, dan responsivitas dalam proses pengadaan tanah menunjukkan bahwa prinsip-prinsip good governance belum diterapkan secara efektif. Kegagalan ini berpotensi meningkatkan konflik sosial di masa depan. | |||||||||
