Abstract

The execution auction of mortgage rights under Article 6 of the Mortgage Law often leads to legal disputes, particularly from debtors who feel disadvantaged by the low limit price set by creditors. In some cases, even though the limit price is determined based on an assessment by a Public Appraisal Service Office (Kantor Jasa Penilai Publik – KJPP), debtors believe that the valuation does not reflect the fair market value of the collateral. This has led some debtors to seek a reassessment from another KJPP, resulting in significantly higher market and liquidation values compared to the limit price set by the creditor. In certain instances, the limit price determined by the creditor is even lower than the liquidation value obtained by the debtor’s reassessment, raising concerns about fairness and transparency in the auction process. This study aims to analyze the mechanism of mortgage right execution auctions, the legal protection available to debtors, and the legal remedies that can be pursued when the limit price falls below the liquidation value. This research adopts a normative-empirical legal approach, utilizing statutory and case study analysis. The findings indicate that although KJPP assessments are intended to ensure transparency and objectivity, discrepancies between the valuation results of different KJPPs create legal uncertainty. Creditors tend to set the limit price based on the lower liquidation value, which may disadvantage debtors by reducing their chances of receiving any remaining proceeds from the sale of their collateral. To safeguard debtor rights, auction procedures must uphold principles of transparency, provide debtors with access to valuation reports before the auction, and allow them the opportunity for private sales to secure a better price. If debtors feel harmed, they may pursue legal remedies through civil lawsuits against creditors or administrative objections to challenge the auction process. Stronger regulatory oversight of the collateral valuation process and limit price determination is necessary to ensure that mortgage right executions are conducted in a transparent, fair, and legally certain manner for all parties involved

Additional Information: Pelaksanaan lelang eksekusi hak tanggungan berdasarkan Pasal 6 UndangUndang Hak Tanggungan sering kali menimbulkan permasalahan hukum, terutama bagi debitur yang merasa dirugikan oleh rendahnya harga limit yang ditetapkan oleh kreditur. Dalam beberapa kasus, meskipun nilai limit telah ditentukan berdasarkan laporan Kantor Jasa Penilai Publik (KJPP), debitur tetap merasa harga yang ditetapkan tidak mencerminkan nilai wajar objek jaminan. Hal ini mendorong debitur untuk melakukan penilaian ulang melalui KJPP lain, yang kemudian menghasilkan nilai pasar dan nilai likuidasi yang jauh lebih tinggi dibandingkan dengan harga limit yang ditetapkan oleh kreditur. Bahkan, dalam beberapa kasus, harga limit yang ditetapkan kreditur lebih rendah dari nilai likuidasi yang diperoleh debitur dari hasil penilaian ulang. Penelitian ini bertujuan untuk menganalisis mekanisme pelaksanaan lelang eksekusi hak tanggungan, bentuk perlindungan hukum bagi debitur dalam proses lelang, serta upaya hukum yang dapat ditempuh oleh debitur apabila harga limit yang ditetapkan berada di bawah nilai likuidasi. Penelitian ini menggunakan metode hukum normatifempiris dengan pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa meskipun penggunaan KJPP dalam menentukan nilai limit seharusnya menjamin transparansi dan objektivitas, perbedaan hasil penilaian antara KJPP yang digunakan kreditur dan KJPP yang digunakan debitur menimbulkan ketidakpastian hukum. Kreditur cenderung menetapkan harga limit berdasarkan nilai likuidasi yang lebih rendah, yang berpotensi merugikan debitur karena berkurangnya kemungkinan mendapatkan sisa hasil penjualan jaminan. Untuk memastikan perlindungan hukum bagi debitur, pelaksanaan lelang harus mengikuti prinsip transparansi, memberikan akses kepada debitur terhadap laporan penilaian sebelum lelang, serta memberikan kesempatan bagi debitur untuk melakukan penjualan di bawah tangan guna memperoleh harga yang lebih optimal. Jika debitur merasa dirugikan, upaya hukum yang dapat ditempuh meliputi gugatan perdata terhadap kreditur maupun keberatan administratif terhadap pelaksanaan lelang yang dinilai tidak sesuai dengan ketentuan hukum. Diperlukan pengawasan lebih ketat terhadap mekanisme penilaian objek jaminan dan penetapan harga limit agar eksekusi hak tanggungan dapat berjalan lebih transparan, adil, dan memberikan kepastian hukum bagi seluruh pihak yang terlibat.
