Abstract

This research examines the protection of civilian objects in armed conflict based on Additional Protocol I of the 1977 Geneva Convention, with a focus on the case study of the attack on the Indonesian Hospital (RSI) in Palestine. Civilian objects include all places and facilities that do not have a military purpose, including buildings, schools, hospitals, and other infrastructure essential for daily life. The problems are: First, How is the regulation related to the protection of civilian objects in Armed Conflict in review of Additional Protocol I to the Geneva Conventions 197? Second, How is the Implementation of Additional Protocol I of the Geneva Convention 1977 on the protection of civilian objects against the case of the attack on the RSI in Palestine? The research method used is normative with a statutory approach and case studies, as well as qualitative descriptive data analysis. The results of this research are as follows: First, Additional Protocol I to the 1977 Geneva Conventions protects civilian objects, including medical facilities, in armed conflicts. The principle of distinction requires the protection of civilians as well as civilian infrastructure unless there is evidence of their use for military purposes with prior warning. However, applying these rules is often constrained, especially in complex conflicts such as Israel-Palestine, which are affected by international political dynamics. Enforcement depends on evidence and global political conditions; both Additional Protocol I to the 1977 Geneva Conventions protect civilian objects, including medical facilities such as RSIs in Palestine. The attack on the RSI reflects the constraints on applying these rules due to international political dynamics. Enforcement depends on evidence and global political decisions, while Israel has not faced significant international sanctions related to the RSI attack in Palestine.

Masalahnya adalah: Pertama Bagaimana pengaturan terkait perlindungan terhadap obyek sipil dalam Konflik Bersenjata di tinjau dari Protokol Tambahan I Konvensi Jenewa 197?: Kedua Bagaimana Implementasi Protokol Tambahan I Konvensi Jenewa 1977 tentang perlindungan obyek sipil terhadap kasus penyerangan RSI di Palestina?. Metode penelitian yang digunakan adalah normatif dengan pendekatan perundang-undangan dan studi kasus, serta analisis data deskriptif kualitatif. Adapun hasil penelitian ini sebagai berikut: Pertama Protokol Tambahan I Konvensi Jenewa 1977 melindungi obyek sipil, termasuk fasilitas medis, dalam konflik bersenjata. Prinsip pembedaan mewajibkan perlindungan warga serta infrastruktur sipil, kecuali ada bukti penggunaannya untuk tujuan militer dengan peringatan sebelumnya. Namun, penerapan aturan ini sering terkendala, terutama dalam konflik kompleks seperti Israel-Palestina, yang dipengaruhi dinamika politik internasional. Penegakan hukum bergantung pada bukti dan kondisi politik global; Kedua Protokol Tambahan I Konvensi Jenewa 1977 melindungi obyek sipil, termasuk fasilitas medis seperti RSI di Palestina. Serangan terhadap RSI mencerminkan kendala penerapan aturan ini akibat dinamika politik internasional. Penegakan hukum bergantung pada bukti dan keputusan politik global, sementara Israel belum menghadapi sanksi internasional yang signifikan terkait dengan kasus penyerangan RSI di Palestina.
