Abstract

Workers have rights that must be protected by law, including workers' rights to occupational health and safety. To achieve this right, the government provides employment social security in the form of work accident insurance for workers who experience work-related diseases and work accidents and death insurance. PT. Sinergy Global Industri does not register its workforce with employment social security. This research was carried out with a focus on how legal protection is for workers who are not registered with employment social security by the Company based on Law Number 24 of 2011 and what legal efforts are taken by workers to fulfill their rights. employment social security. The theory used is the theory of legal protection and the theory of justice. The research method used uses the normative juridical method with a statutory approach and the empirical research method is by conducting interviews. The data sources used are primary and secondary data sources that are analyzed qualitatively. The results of the research from the case study conducted by the author are employees of PT. Sinergi Global Industri are entitled to legal protection in the form of being given BPJS Employment facilities by the Sinergi Global Industri company because there are employees who are not registered for BPJS Employment. Law Number 24 of 2011 in Article 15 paragraph (1) which requires employers to register themselves and their workers as BPJS employment participants in accordance with the social security program. And legal efforts made by labor unions and workers through bipartite negotiations with family deliberations that prioritize justice. Companies are advised to immediately register all their employees with BPJS Ketenagakerjaan in accordance with applicable laws and regulations and the government needs to increase the intensity of labor inspections to monitor the Company's compliance with social security obligations.

Additional Information: Pekerja memiliki hak yang harus dilindungi oleh hukum, termasuk hak pekerja atas kesehatan dan keselamatan kerja. Untuk mencapai hak tersebut, pemerintah memberikan jaminan sosial ketenagakerjaan bagi tenaga kerja yang mengalami penyakit akibat kerja dan kecelakaan kerja dan jaminan kematian. Namun, PT. Sinergi Global Industri tidak mendaftarkan tenaga kerjanya jaminan sosial ketenagakerjaan. Penelitian ini dilaksanakan dengan mengambil fokus mengenai bagaimana perlindungan hukum terhadap tenaga kerja yang tidak didaftarkan jaminan sosial ketenagakerjaan oleh Perusahaan berdasarkan Undang-Undang Nomor 24 tahun 2011 dan bagaimana upaya hukum yang di lakukan pekerja dalam pemenuhan hak jaminan sosial ketenagakerjaan. Teori yang digunakan yaitu teori perlindungan hukum dan teori keadilan. Metode penelitian yang dipakai menggunakan metode yuridis normatif dengan pendekatan undang-undang dan metode penelitian yuridis empiris yaitu dilakukannya wawancara. Sumber data yang digunakan adalah sumber data primer dan sekunder yang dianalisis secara kualitatif. Hasil penelitian dari studi kasus yang dilakukan oleh penulis adalah karyawan PT. Sinergi Global Industri berhak mendapatkan perlindungan hukum berupa diberikannya fasilitas BPJS Ketenagakerjaan oleh perusahaan Sinergi Global Industri dikarenakan terdapat karyawan yang tidak didaftarkan BPJS Ketenagakerjaan. Undang-Undang Nomor 24 Tahun 2011 pada Pasal 15 ayat (1) yang mewajibkan pemberi kerja mendaftarkan diri dan para pekerjanya sebagai peserta BPJS Ketenagakerjaan sesuai dengan program jaminan sosial. Dan upaya hukum yang dilakukan serikat buruh dan pekerja melalui diskusi terbuka dengan musyawarah secara kekeluargaan yang mengedepankan keadilan. Perusahaan di sarankan untuk segera mendaftarkan seluruh pekerjanya ke BPJS Ketenagakerjaan sesuai dengan ketentuan perundang-undangann yang berlaku dan pemerintah perlu meningkatkan intensitas inpeksi ketenagakerjaan untuk memantau kepatuhan Perusahaan terhadap kewajiban jaminan sosial.
