Abstract
The implementation of the Convention on the Rights of Persons with Disabilities (CRPD) in Indonesia still faces various challenges, particularly in the context of law enforcement. A case of embezzlement in Semarang, where the perpetrator—a person with a physical disability—was sentenced to one year of imprisonment, highlights that the integration of the CRPD into the national legal system has not been fully realized. This case reflects the need for further research on the application and regulation of the CRPD in Indonesia, with a focus on protecting the rights of persons with disabilities in the judicial process and the impact of imprisonment on their lives. The method used is normative juridical with a qualitative research approach, employing a descriptive analysis of legal documents and case studies to gather detailed information and explore the specific context of the case. By analyzing this concrete case, it is expected to provide a clear picture of the challenges in implementing the CRPD. The findings of the study show that despite Indonesia having ratified the CRPD, the legal application in this case does not reflect CRPD principles, and the imprisonment imposed is deemed ineffective as it is not aligned with Indonesia’s regulations based on the CRPD ratification. The conclusion of the study emphasizes that the Indonesian government needs to reform legal frameworks concerning the rights of persons with disabilities and conduct socialization efforts to raise awareness about their rights within the judicial system. This would ensure more effective and just protection in accordance with the principles of the CRPD and human rights.

| Additional Information: | Penerapan Konvensi Hak-Hak Penyandang Disabilitas (CRPD) di Indonesia masih menemui berbagai tantangan, terutama dalam konteks penegakan hukum. Kasus penggelapan yang terjadi di Semarang, dimana pelaku yang merupakan penyandang disabilitas fisik dijatuhi hukuman penjara selama satu tahun. Hal ini menunjukan bahwa implementasi CRPD belum sepenuhnya diintegrasikan ke dalam sistem hukum nasional secara sempurna. Kasus ini mencerminkan perlunya penelitian lebih lanjut mengenai penerapan dan pengaturan CRPD di Indonesia dengan berfokus pada perlindungan hak-hak penyandang disabilitas dalam proses peradilan, serta dampak hukuman terhadap kehidupan mereka. Metode yang digunakan yaitu yuridis normatif dengan jenis penelitian kualitatif dan bersifat deskriptif, melibatkan analisis terhadap dokumen hukum dan studi kasus dilakukan agar dapat menggali informasi secara detail, serta mendalami konteks secara spesifik. Dengan menganilisis kasus secara konkret, diharapkan dapat memberikan gambaran yang jelas mengenai tantangan yang dihadapi dalam penerapan CRPD. Hasil penelitian menunjukan bahwa meskipun Indonesia telah meratifikasi CRPD, penerapan hukum dalam kasus ini tidak mencerminkan prinsip-prinsip CRPD dan penjatuhan hukuman penjara yang dijatuhkan dinilai tidak efektif karena tidak selaras dengan peraturan di Indonesia berdasarkan ratifikasi CRPD. Kesimpulan dari penelitian ini adalah pemerintah Indonesia perlu melakukan reformasi hukum terhadap pengaturan hak-hak penyandang disabilitas dan melakukan sosialisasi untuk meningkatkan kesadaran mengenai hak-hak penyandang disabilitas dalam sistem peradilan, sehingga pengaturan perlindungan terhadap penyandang disabilitas dapat lebih efektif dan berkeadilan sesuai dengan prinsip-prinsip CRPD dan hak asasi manusia. | |||||||||
