Abstract
Indonesia, as a strategically maritime nation, is certainly vulnerable to marine pollution due to human activities, such as the MV Ever Judger incident that caused an oil pipeline leak in Balikpapan Bay. Polluter Pays Principle, as outlined in the Rio Declaration and regulated by Law Number 32 of 2009, is an important instrument for holding polluters accountable for recovery and compensation costs. This study aims to analyze the implementation of this principle by Indonesia, particularly its effectiveness in Balikpapan Bay, using legal transformation theory and the polluter pays principle. The method used is normative legal analysis with a quantitative approach through the study of related regulations and legal practices. The research results show that although this principle has been adopted, its implementation is hindered by regulatory ambiguities and weak law enforcement. The recommendation from this research is that the Indonesian government needs to strengthen regulations, enforce the law, and enhance environmental responsibility socialization programs for the community and business actors.

| Additional Information: | Indonesia sebagai negara maritim strategis, tentu rentan terhadap pencemaran laut akibat aktivitas manusia, seperti insiden MV Ever Judger yang menyebabkan kebocoran pipa minyak di Teluk Balikpapan. Polluter Pays Principle (prinsip pencemar membayar), sebagaimana tertuang dalam Deklarasi Rio dan diatur dalam Undang-Undang Nomor 32 Tahun 2009, merupakan instrumen penting untuk menuntut tanggung jawab pencemar atas biaya pemulihan dan kompensasi. Penelitian ini bertujuan menganalisis implementasi prinsip ini oleh Indonesia, khususnya efektivitas penerapannya di Teluk Balikpapan, dengan menggunakan teori transformasi hukum dan prinsip pencemar membayar. Metode yang digunakan adalah analisis yuridis normatif dengan pendekatan kuantitatif melalui kajian peraturan dan praktik hukum terkait. Hasil penelitian menunjukkan bahwa meskipun prinsip ini telah diadopsi, implementasinya terhambat oleh ketidakjelasan regulasi dan lemahnya penegakan hukum. Saran dari penelitian ini adalah Pemerintah Indonesia perlu melakukan penguatan regulasi, penegakan hukum, serta meningkatkan program sosialisasi tanggung jawab lingkungan kepada masyarakat dan pelaku usaha. | |||||||||
