Abstract
In modern times people commit crimes in a variety of modern ways, both the tools used or the way the crime is committed. Crimes that occur in society have various forms and types, one example is murder. Murder in the Criminal Code is divided into several types including ordinary murder and premeditated murder. Ordinary murder is regulated in article 338 of the Criminal Code while premeditated murder is regulated in article 340 of the Criminal Code. This research was conducted to find out how the indicators of the application of article 340 of the Criminal Code in murder cases and to find out how the fulfillment of the elements of premeditated murder in Law Number 1 of 2023 concerning the Criminal Code. The research method used is the normative juridical method, namely by examining court decisions and examining library legal materials or secondary data, namely the opinions of legal experts, legal journals, books and legal dictionaries and using primary data as supporting data, namely legal norms or laws and regulations related to the object of research. The results of this study indicate that the indicators in the fulfillment of the elements of planning are deciding the will in a calm atmosphere, sufficient time is available from the emergence of the will to the implementation of the will, the implementation of the will in a calm atmosphere. And, regarding the fulfillment of the element of premeditated murder in Law Number 1 of 2023 concerning the Criminal Code, the element “intentionally” is not included, which is a difference from the old Criminal Code.

| Additional Information: | Di zaman modern orang melakukan kejahatan dengan berbagai macam cara yang serba modern, baik alat yang digunakan atau cara melakukan kejahatan tersebut. Kejahatan yang terjadi dalam masyarakat memiliki berbagai bentuk dan jenis salah satu contohnya adalah pembunuhan. Pembunuhan dalam KUHP terbagi dalam beberapa jenis diantaranya yaitu pembunuhan biasa dan pembunuhan berencana. Pembunuhan biasa diatur dalam pasal 338 KUHP sedangkan pembunuhan berencana diatur dalam pasal 340 KUHP. Penelitian ini dilakukan untuk mengetahui bagaimana indikator penerapan pasal 340 KUHP dalam kasus pembunuhan dan mengetahui bagaimana pemenuhan unsur perbuatan pembunuhan berencana di dalam Undang-Undang Nomor 1 Tahun 2023 Tentang Kitab Undang-Undang Hukum Pidana. Metode penelitian yang digunakan adalah metode yuridis normatif yaitu dengan cara menelaah putusan pengadilan dan meneliti bahan hukum pustaka atau data sekunder yaitu pendapat pakar hukum, jurnal-jurnal hukum, buku-buku serta kamus hukum dan menggunakan data primer sebagai data pendukung yaitu norma hukum atau peraturan perundang-undangan yang terkait dengan objek penelitian. Adapun hasil dari penelitian ini menunjukan bahwa indikator dalam pemenuhan unsur berencana yaitu memutuskan kehendak pada suasana tenang, tersedia waktu yang cukup sejak timbulnya kehendak sampai dengan pelaksaan kehendak, pelaksanaan kehendak dalam suasana tenang. Dan, mengenai pemenuhan unsur perbuatan pembunuhan berencana di dalam Undang-Undang Nomor 1 Tahun 2023 Tentang Kitab Undang-Undang Hukum Pidana, unsur “dengan sengaja” tidak dicantumkan hal tersebut yang menjadi pembeda dari KUHP lama. | |||||||||
