Abstract
The existence of election supervisors in the political and administrative law review is important to avoid delegitimization of the election process and results, as well as to anticipate the development of various election violations based on an integrated and comprehensive legal system. The focus of the research to be carried out by the author is on the supervision carried out by the Banten Province Bawaslu in handling findings and reports of election violations in the prepreparation for the 2024 election in Banten Province. This study will analyze two main focuses related to how Bawaslu's supervision is implemented and what are the obstacles for the Banten Province Bawaslu in implementing supervision of violations in the Implementation of the 2024 Election in Banten based on Bawaslu Regulation Number 7 of 2022. The theories used in this study are Supervision Theory and Law Enforcement Theory. The method used is Qualitative with an empirical legal approach with descriptive analytical research specifications. The results of this study are that Bawaslu has implemented supervision of election violations in 2024. The obstacles experienced by Bawaslu are related to the limited quantity of election supervisors in Banten Province. Administrative violations still occupy the top position with the most violations, namely 8 violations regarding the installation of Campaign Equipment, using government facilities, using places of worship and using government offices in campaigning, 2 criminal violations in general elections such as money politics, 5 violations of the code of ethics, and 7 other laws. The limited quantity of election supervisors and the limited time to handle election violations is short with the burden of pressure and limited quality of human resources as regulated in Article 92 of Law Number 7 of 2017 concerning General Elections, the number of Bawaslu members consists of 5 people at the Central Bawaslu level, 5 or 7 people at the Provincial level; 3 or 5 people at the Regency/City level; and 3 sub-district Panwaslu. The conclusion is that the Banten Province Bawaslu has implemented Perbawaslu Number 7 of 2022, although it still experiences several obstacles. The suggestions in this study are to increase the institutional role, harmonization of laws and regulations between the KPU and Bawaslu, and the addition of human resources tasked with supervising election violations so that there is increased supervision of violations that occur during the election

| Additional Information: | Keberadaan pengawas pemilu dalam tinjauan politik dan hukum administrasi, bersifat penting untuk menghindari delegitimasi terhadap proses dan hasil pelaksanaan pemilu, serta antisipasi perkembangan berbagai tindak pelanggaran kepemiluan berdasarkan tata hukum secara terpadu dan menyeluruh. Fokus penelitian yang akan dilakukan oleh penulis yakni pada pengawasan yang dilakukan oleh Bawaslu Provinsi Banten dalam penanganan temuan dan laporan pelanggaran pemilu pada pra persiapan pemilu tahun 2024 di Provinsi Banten. Penelitian ini akan menganalisis dua fokus utama terkait bagaimana implementasi pengawasan Bawaslu? dan apa saja kendala bawaslu Provinsi Banten dalam implementasi pengawasan pelanggaran pada Pelaksanaan Pemilu 2024 di Banten berdasarkan Peraturan Bawaslu Nomor 7 Tahun 2022?. Teori yang digunakan dalam penelitian ini yaitu Teori Pengawasan dan Teori Penegakkan Hukum. Metode yang digunakan adalah Kualitatif dengan pendekatan yuridis empiris dengan spesifikasi penelitian deskriptif analisis. Adapun hasil dalam penelitian ini yaitu Bawaslu sudah mengimplementasikan pengawasan pelanggaran pemilu tahun 2024. Adapun kendala yang dialami Bawaslu adalah terkait keterbatasan kuantitas pengawas pemilu di Provinsi Banten. Pelanggaran administrasi masih menduduki posisi teratas paling terbanyak pelanggaran yaitu 8 pelanggaran mengenai pemasangan Alat Peraga Kampanye, menggunakan fasilitas pemerintah, menggunakan tempat ibadah dan menggunakan kantor pemerintahan dalam berkampanye, pelanggaran pidana 2 perkara dalam pemilihan umum seperti melakukan politik uang biasa disebut money politic, pelanggaran kode etik 5 perkara, dan hukum lainnya 7 perkara. Keterbatasan kuantitas pengawas pemilu dan terbatasnya waktu penanganan pelanggaran pemilu yang singkat dengan beban tekanan dan kualitas sumber daya manusia yang terbatas sebagaimana diatur dalam Pasal 92 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, Jumlah anggota Bawaslu terdiri dari 5 Orang tingkat Bawaslu Pusat, 5 atau 7 orang tingkat Provinsi; 3 atau 5 orang tingkat Kab/Kota; dan Panwaslu kecamatan sebanyak 3 orang. Kesimpulannya adalah Bawaslu Provinsi Banten telah mengimplementasikan Perbawaslu Nomor 7 Tahun 2022, walaupun masih mengalami beberapa hambatan. Saran dalam penelitian ini yaitu meningkatkan peran kelembagaan, harmonisasi peraturan perundang-undangan antara KPU dengan Bawaslu, dan penambahan SDM yang bertugas sebagai pengawas v pelanggaran pemilu sehingga terciptanya peningkatan pengawasan terhadap pelanggaran-pelanggaran yang terjadi saat pemilu. | |||||||||
