Abstract
Air transportation is one of the most popular means of transportation for the Indonesian people because it feels more comfortable and saves time. The implementation of an air transportation in transportation activities has many problems such as in the airline PT Lion Air, namely accidents to airplane passengers. aircraft accidents that result in death or permanent disability; and damaged, destroyed or lost items placed in checked baggage. This study aims to find out the responsibility of airlines to passengers for aircraft accidents based on law Number 1 of 2009 concerning aviation and legal remedies in the event of a Lion Air aircraft accident at Karawang Beach against passengers. The research method used is a normative legal research method (normative juridical) with a conceptual approach, a case approach and a legal approach. The research specification carried out is descriptive analytical, by presenting an sportation in transportation activities has many problems such as in the airline PT Lion Air, namely accidents to airplane passengers. aircraft accidents that result in death or permanent disability; and damaged, destroyed or lost items placed in checked baggage. This study aims to find out the responsibility of airlines to passengers for aircraft accidents based on law Number 1 of 2009 concerning aviation and legal remedies in the event of a Lion Air aircraft accident at Karawang Beach against passengers. The research method used is a normative legal research method (normative juridical) with a conceptual approach, a case approach and a legal approach. The research specification carried out is descriptive analytical, by presenting an analysis of problem identification based on secondary data in the form of primary huum materials, and secondary legal materials. Then data analysis is carried out qualitatively. The results of this study show that the responsibility of the airline does not provide appropriate compensation in Law Number 1 of 2009 to the victim who experienced a plane accident, the second legal remedy carried out by the victim for the aircraft accident is one of them by suing Boeing as the provider of the aircraft engine that experienced a malfunction during the accident.

| Additional Information: | Angkutan udara merupakan salah satu alat transportasi yang paling banyak diminati masyarakat Indonesia karena terasa lebih nyaman serta menghemat waktu. Terselenggaranya suatu pengangkutan udara dalam kegiatan pengangkutan memiliki banyak permasalahan seperti pada maskapai penerbangan PT Lion Air yaitu kecelakaan terhadap penumpang pesawat. kecelakaan pesawat yang mengakibatkan meninggal dunia atau cacat tetap; serta rusak, musnah atau kehilangan barang yang diletakkan pada bagasi tercatat. Penelitian ini bertujuan untuk, mengetahui Tanggung jawab maskapai penerbangan terhadap penumpang atas kecelakaan pesawat berdasarkan undang-undang Nomor 1 Tahun 2009 tentang penerbangan dan Upaya hukum dalam hal terjadinya kecelakaan pesawat Lion Air di Pantai Pakis Karawang terhadap penumpang. Metode Penelitian yang digunakan yaitu metode penelitian hukum normatif (yuridis normatif) dengan pendekatan konseptual, pendekatan kasus dan pendekatan undang-undang. Spesifikasi Penelitian yang dilakukan bersifat deskriptif analitis, dengan menyajikan Analisa terhadap identifikasi masalah berdasarkan data sekunder berupa bahan huum primer, dan bahan hukum sekunder. Kemudian analisis data dilakukan secara kualitatif. Hasil penelitian ini menunjukkan bahwa tanggung jawab pihak maskapai penerbangan tidak memberikan ganti rugi yang sesuai dalam Undang-Undang Nomor 1 Tahun 2009 terhadap korban yang mengalami kecelakaan pesawat, Kedua Upaya Hukum yang dilakukan pihak korban terhadap kecelakaan pesawat salah satunya dengan cara menggugat Boeing selaku penyedia mesin pesawat yang mengalami gagal fungsi saat terjadinya kecelakaan. | |||||||||
