Abstract
Serang City has undergone significant developments as a regional government organization, with a growing demand for telecommunications consumers as seen by the a lot telecommunications service providers. Therefore, serious spatial planning is required, particularly for telecommunications infrastructure, as allowed by: (1) Government Regulation Number 34 of 2006 about Roads, Article 35 Paragraph 6, Article 47 Paragraph 2; (2) Regulation Number 20 PRT/M/2010 of the Minister of Public Works about Guidelines for the Utilization and Use of Road Sections, Article 12 Paragraph 1; (3) Regional Regulation Number 8 of 2020 pertaining to the City of Serang's Spatial Planning Plan, Articles 7 Paragraph 6 Letter f, 8 Paragraph 3 Letter c, and 14; (4) Article 23 Letter c, Article 31 of Regional Regulation Number 9 of 2014 Detailed Spatial Planning Plan for the City of Serang. The researcher conducted identification and analysis based on the aforementioned legislation, yielding the following results: First, the placement of telecommunications infrastructure on right-of-way space in accordance with laws and regulations is a form of legal certainty for telecommunications service providers and also provides convenience for road users. Permitting the use of right-of-way space for telecommunications infrastructure and coordinating with the Public Works and Spatial Planning Office to determine whether the implementation of the installation of telecommunications infrastructure is in accordance with the established technical recommendation guidelines are among the duties and responsibilities of the Serang City Investment and One-Stop Integrated Service Office, as outlined in Mayor Regulation Number 122 of 2021 concerning the Position, Organizational Structure, Duties and Functions, and Work Procedures of the Serang City Investment and One-Stop Integrated Service Office. Second, there is an a mismatch between the legal principle (das sollen) and the actual situation (das sein) on the matter of comes to regulating telecommunications infrastructure in right-of-way space. According to the Serang City Roadways, the distance between telecommunications poles should not exceed 50 meters, and the poles are located above the sidewalk or pedestrian area. Additionally, the height of the cable does not adhere to the free space requirements, which are 5 meters from the road surface as stipulated in Article 35 paragraph 6, Article 47 paragraph 2 of Government Regulation Number 34 of 2006 concerning Roads, and Article 12 paragraph 1 of the Regulation of the Minister of Public Works Number 20 PRT/M/2010 concerning Guidelines for the Utilization and Use of Road Parts.

Additional Information: | Sebagai penyelenggara pemerintah daerah, Kota Serang telah mengalami perkembangan yang sangat dinamis yang dimana kebutuhan terhadap pengguna telekomunikasi semakin meningkat yang dapat dilihat dengan banyak penyedia jasa telekomunikasi. Sehingga perlu adanya penataan ruang secara substansial, khususnya pada infrastruktur telekomunikasi yang telah diakomodir dalam : (1) Pasal 35 Ayat 6, Pasal 47 Ayat 2 PP Nomor 34 Tahun 2006 Tentang Jalan; (2) Pasal 12 Ayat 1 Permen PU Nomor 20 PRT/M/2010 Tentang Pedoman Pemanfaatan dan Penggunaan Bagian-Bagian Jalan; (3) Pasal 7 Ayat 6 Huruf f, Pasal 8 Ayat 3 Huruf c, Pasal 14 Perda Nomor 8 Tahun 2020 Tentang RTRW Kota Serang; (4) Pasal 23 Huruf c, Pasal 31 Perda Nomor 9 Tahun 2014 RDTR Kota Serang. Mengacu pada perundang-udangan tersebut tersebut, peneliti melakukan identifikasi serta menganalisa dengan hasil berikut: Pertama Penempatan infrastruktur telekomunikasi pada rumija yang sesuai dengan peraturan perundang-undangan merupakan bentuk kepastian hukum bagi penyedia jasa telekomunikasi dan juga memberikan kenyamanan bagi pengguna jalan. DPMPTSP Kota Serang memiliki peran dan tanggung jawab dalam penerbitan izin yang diatur dalam Perwal Nomor 122 Tahun 2021 Tentang Kedudukan, Susunan Organisasi, Tugas dan Fungsi Serta Tata Kerja DPMPTSP Kota Serang, salah satunya adalah perizinan pemanfaatan rumija untuk infrastruktur telekomunikasi dan berkordinasi dengan DPUPR apakah pelaksanaan pemasangan infrastruktur telekomunikasi telah sesuai dengan pedoman rekomendasi teknis yang telah ditetapkan. DPUPR Bidang Bina Marga Kota Serang memiliki peran dan tanggung jawab dalam pemeliharaan, pengawasan, pembinaan, evaluasi, rekomendasi teknis serta pemantauan rumija yang diatur dalam Perwal Nomor 112 Tahun 2021 Tentang Kedudukan, Susunan Organisasi, Tugas dan Fungsi Serta Tata Kerja DPUPR Kota Serang; Kedua dalam mengatur infrastruktur telekomunikasi yang terdapat dalam rumija terdapat ketidaksesuian antara kaidah hukum (das sollen) dengan keadaan yang nyata (das sein), yaitu jarak antara tiang telekomunikasi tidak sampai 50 Meter berdasarkan rekomendasi Bina Marga Kota Serang, dan lokasi tiang berada diatas pedestrian/trotoar, tinggi kabel tidak sesuai dengan ketentuan ruang bebas yaitu 5 meter dari permukaan jalan sebagaimana telah diatur dalam Pasal 35 Ayat 6, Pasal 47 Ayat 2 PP Nomor 34 Tahun 2006 Tentang Jalan serta Pasal 12 Ayat 1 Permen PU Nomor 20 PRT/M/2010 Tentang Pedoman Pemanfaatan dan Penggunaan Bagian-Bagian Jalan. | |||||||||
