Abstract

Indonesian Migrant Workers have a positive impact in the form of reducing unemployment in the country, increasing the economic welfare of Migrant Worker families, gaining skills, experience and increasing the country's foreign exchange. Although providing many positive impacts, Indonesian migrant workers are vulnerable to cases including the imposition of excessive placement fees, namely fees charged by the Indonesian Migrant Worker Placement Company (P3MI) exceeding the upper limit set by the regulations. Based on this background, the researcher took two identifications of problems, namely how the legal regulations for the imposition of placement fees on Indonesian Migrant Workers and what are the legal consequences of PT. Samawa Mandiri as a P3MI that charges placement fees to Indonesian Migrant Workers. The theory used is the theory of legal protection. This study uses empirical juridical. The research specifications used are descriptive analytical research, using primary and secondary data sources. The data collection techniques for this study are field research and literature. Data analysis uses a qualitative approach. The results of the study showed that legal protection for Indonesian Migrant Workers is still not optimal, because PT Putri Samawa Mandiri as P3MI still has several weaknesses, namely not balancing the rules contained in Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers and the company does not provide rights and obligations to Indonesian Migrant Workers, namely by imposing placement fees on Indonesian Migrant Workers, it is said to have deviated from the applicable laws and company regulations. This can be said to be an illegal act. So that the legal protection of Indonesian Migrant Workers is still entitled to their rights based on applicable regulations, in the sense that the company is obliged to repay the Indonesian Migrant Workers for the collection of placement fees made. So the suggestion in this study is expected that if the company has insufficient costs that Indonesian Migrant Workers are required to pay, a bipartite dialogue needs to be carried out to reach an agreement between the company and Indonesian Migrant Workers.

Additional Information: Pekerja Migran Indonesia memberikan dampak positif berupa pengurangan pengangguran di dalam negeri, meningkatkan kesejahteraan ekonomi keluarga Pekerja Migran, memperoleh ketrampilan, pengalaman dan menambah devisa negara. Meskipun memberikan banyak dampak positif pekerja migran Indonesia rawan terkena kasus diantaranya pengenaan biaya penempatan berlebih, yaitu biaya yang dikenakan oleh Perusahaan Penempatan Pekerja Migran Indonesia (P3MI) melebihi batas atas yang ditetapkan peraturan. Berdasarkan latar belakang tersebut, peneliti mengambil dua identifikasi masalah yaitu bagaimana pengaturan hukum atas pengenaan biaya penempatan kepada Pekerja Migran Indonesia dan bagaimana akibat hukum PT. Samawa Mandiri sebagai P3MI yang memungut biaya penempatan kepada Pekerja Migran Indonesia. Teori yang digunakan teori perlindungan hukum. Penelitian ini menggunakan yuridis empiris. Spesifikasi penelitian yang digunakan penelitian deskriptif analitis, menggunakan sumber data primer dan sekunder. Teknik pengumpulan data penelitian ini yaitu penelitian lapangan dan kepustakaan. Analisis data mengunakan pendekatan kualitatif. Hasil penelitian diperoleh bahwa perlindungan hukum bagi Pekerja Migran Indonesia masih belum maksimal, dikarenakan PT Putri Samawa Mandiri sebagai P3MI masih memiliki beberapa kelemahan yaitu tidak balancing antara aturan yang terdapat pada Undang-undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia dan perusahaan tidak memberikan hak dan kewajiban terhadapPekerja Migran Indonesia yaitu dengan melakukan pengenaan biaya penempatan kepada Pekerja Migran Indonesia dikatakan sudah menyimpang dari Undang�Undang dan peraturan perusahaan yang berlaku. Hal tersebut dapat dikatakan sebagai perbuatan yang tidak sah. Sehingga perlindungan hukumnya Pekerja Migran Indonesia tetap berhak atas haknya mereka berdasarkan peraturan yang berlaku, dalam artian perusahaan wajib membayar kembali kepada Pekerja Migran Indonesia atas pemungutan biaya penempatan yang dilakukan. Sehingga saran dalam penelitian ini diharapkan bilamana perusahaan ada biaya kurang yang diharuskan Pekerja Migran Indonesia membayar, perlu dilakukan dialog secara bipartit untuk mendapatkan kesepakatan antara perusahaan dengan Pekerja Migran Indonesia.
