Abstract
Wage deductions are a legal act. Government Regulation Number 36 of 2021 on wage management stipulates that wage deductions must be carried out in accordance with the Employment Agreement, Company Regulations, and Collective Labor Agreement. In practice, in Indonesia today, there are still employers who cut wages not in accordance with the implementation of the Employment Agreement. This research is conducted to understand how the regulation and implementation of wage deductions for workers according to Government Regulation Number 36 of 2021 on Wages and whether the implementation of wage deductions for PT. Sumber Alfaria Trijaya, Tbk workers at the Alfamart counter in Tirtayasa District is in accordance with Article 63 of Government Regulation Number 36 of 2021 Jo Company Regulations. The theories used are the theory of legal protection and the theory of employment contracts. This research uses an empirical juridical method with a specification of descriptive-analytical research. The technique for collecting secondary data is obtained through literature studies, and primary data is obtained from interviews. The research results show that the practice of the employment agreement regarding compensation for lost goods at the Alfamart Tirtayasa branch does not align with the agreed-upon fixed-term employment contract because if there is still a negative balance, all workers remain responsible by purchasing goods/products at the mini market. Therefore, it has violated the legal protection in fulfilling workers' wage rights and contravened the provisions of Article 52 paragraph (1) letter (a) of Law Number 13 of 2003 concerning Manpower, which states that employment agreements are based on the mutual agreement of both parties, and contrary to Article 63 paragraph (2) of Government Regulation Number 36 of 2021 concerning Wages, which states that wage deductions as referred to in paragraph (1) letter (b) for compensation are carried out in accordance with the employment agreement, company regulations, and collective labor agreement. .

Peraturan pemerintah Nomor 36 Tahun 2021 Tentang pengupahan mengatur bahwa pemotongan upah harus dilakukan sesuai dengan Perjanjian Kerja, Peraturan Perusahaan, dan Perjanjian Kerja Bersama. Praktiknya di Indonesia saat ini, masih ada pengusaha yang memotong upah tidak sesuai dengan pelaksanaan Perjanjian Kerja. Penelitian ini dilakukan untuk mengetahui Bagaimana Pengaturan dan Pelaksanaan Pemotongan upah Pekerja menurut Peraturan Pemerintah Nomor 36 Tahun 2021 Tentang Pengupahan Dan Apakah Pelaksanaan Pemotongan upah Pekerja PT. Sumber Alfaria Trijaya, Tbk di konter Alfamart Kecamatan Tirtayasa sesuai dengan Pasal 63 Peraturan Pemerintah Nomor 36 Tahun 2021 Jo Peraturan Perusahaan. Teori yang digunakan yaitu teori perlindungan hukum dan teori perjanjian kerja. Penelitian ini menggunakan metode yuridis emperis dengan spesifikasi penelitian deskriptif analitis. Teknik pengumpulan data sekunder di peroleh dengan melakukan studi kepustakaan dan data primer diperoleh dari hasil wawancara. Hasil penelitian menunjukkan bahwa praktik perjanjian kerja terhadap ganti rugi barang yang hilang di Alfamart cabang Tirtayasa tidak sesuai dengan perjanjian kerja waktu tertentu yang telah disepakati karena apabila masih terjadi selisih minus semua pihak pekerja tetap bertanggung jawab dengan cara membeli barang/produk di mini market. Maka dari itu telah mecederai perlindungan hukum dalam pemenuhan hak upah pekerja dan melanggar ketentuan Pasal 52 ayat (1) huruf (a) Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan bahwa perjanjian kerja di bua tatas dasar kesepakatan kedua belah pihak dan bertentangan dengan pasal 63 ayat (2) Peraturan Pemerintah Nomor 36 Tahun 2021 tentang Pengupahan bahwa pemotongan upah sebagaimana dimaksud pada ayat (1) huruf (b) yaitu ganti rugi dilakukan sesuai dengan perjanjian kerja, peraturan Perusahaan, dan perjanjian kerja bersama. | |||||||||
