Abstract
The development of technology in the digital world is very rapid, the relationship between the wider community cannot be limited, for example now space and time are unlimited or borderless so that the existence of the ITE Law can at least restrain the criminal rate in online media, but not a few people use this online media for their personal or group interests to the detriment of other parties. The problem identification in this study is how the law enforcement of decision 51/Pid.B/2021/PN Plp is related to law enforcement and the imposition of verdicts that are far from the maximum criminal threat in terms of Law Enforcement Theory and Ratio Decidendi Theory. This research uses normative juridical research methods (Legal Research). The type of data uses secondary data consisting of 3 (three) legal materials, namely Primary (Laws, Decisions), secondary (Books, Journals) and tertiary (dictionaries, law, Internet). This research is descriptive analysis through a statute approach. Data collection techniques are library research. Data analysis using Qualitative analysis. The results of the research obtained are the judge's consideration in the decision 51/Pid.B/2021/PN Plp, the ITE Law has fulfilled 4 elements in it. Juridical consideration of the defendant's testimony during the trial, the defendant said that there were still other victims, which means that the defendant in this case committed an act against or against the law with many victims. Non-juridical considerations the actions taken by the defendant have harmed many victims, while in law enforcement the 5 factors of law enforcement are perfect, starting from law enforcement factors, community factors, and infrastructure factors. The conclusion in the crime of fraud through Facebook e-commerce, law enforcement in this case the Panel of Judges in deciding the verdict against the defendant is far from the maximum criminal threat then the Judge should be able to apply the ITE Law because the beginning of the occurrence starts from promotion, transactions, and communication through electronic media, the aim is to impose severe sanctions and provide a deterrent effect on the perpetrator.

| Additional Information: | Perkembangan teknologi dalam dunia digital yang sangat pesat, hubungan antar masyarakat luas tidak bisa dibatasi, misalnya sekarang ini ruang dan waktu sudah tidak terbatas atau borderless sehingga adanya UU ITE ini paling tidak bisa menahan laju criminal dalam media online, namun tidak sedikit para oknum menggunakan media online ini untuk kepentingan pribadinya atau kelompoknya dengan merugikan pihak lain. Identifikasi masalah pada penelitian ini adalah bagaimana penegakan hukum terhadap putusan 51/Pid.B/2021/PN Plp berkaitan dengan penegakan hukum dan penjatuhan putusan yang jauh dari ancaman pidana maksimal ditinjau dari Teori Penegakan Hukum dan Teori Ratio Decidendi. Penelitian ini menggunakan metode penelitian yuridis normatif (Legal Research). Jenis data menggunakan data sekunder yang terdiri dari 3 (tiga) bahan hukum yaitu Primer (Undang-undang, Putusan), sekunder (Buku, Jurnal) dan tersier (kamus, hukum, Internet). Penelitian ini bersifat deskriptif analisis melalui pendekatan undang-undang (Statute Approach). Teknik pengumpulan data studi kepustakaan (library research). Analisis data menggunakan analisis Kualitatif. Hasil penelitian yang didapat yaitu pertimbangan hakim pada putusan 51/Pid.B/2021/PN Plp, Undang-undang ITE telah memenuhi 4 unsur didalam nya. Pertimbangan Yuridis keterangan terdakwa dalam persidangan terdakwa mengatakan bahwasannya masih ada korban lainnya yang artinya terdakwa dalam hal ini melakukan perbuatan melawan atau melanggar hukum dengan banyak nya korban. Pertimbangan Non yuridis perbuatan yang dilakukan terdakwa telah merugikan banyak korban, sedangkan dalam penegakan hukum sempurnanya 5 faktor penegakan hukum mulai dari faktor penegak hukum, faktor masyarakat, dan faktor sarana prasarana,. Kesimpulan dalam tindak pidana penipuan melalui e-commerce facebook, penegak hukum dalam hal ini Majelis Hakim dalam memutus vonis terhadap terdakwa jauh dari ancaman pidana maksimal kemudian seyogyanya Hakim dapat menerapkan UU ITE karena awal mula terjadinya mulai dari promosi, transaksi, dan komunikasi melalui media elektronik, tujuannya untuk memberikan sanksi yang berat dan memberikan efek jera terhadap pelaku. | |||||||||
