Abstract
The implementation of the authority of the Central Statistics Agency (BPS) in Tangerang City in conducting the Population Census, based on Law No. 16 of 1997 on Statistics, aims to produce valid and integrated population data to support development policies in the region. The main focus of this research is: How does BPS Tangerang City exercise its authority in conducting the Population Census based on Law No. 16 of 1997? And what obstacles does BPS Tangerang City face in conducting the Population Census based on this law? This research employs Authority Theory and Legal Effectiveness Theory, using an empirical juridical method and a qualitative descriptive approach. Data sources include primary data supported by secondary data, and data collection techniques involve interviews. The research results show that BPS Tangerang City has exercised its authority well through various innovations, such as online census methods and field census. However, several obstacles remain, such as low public participation and challenges in data collection in certain areas, particularly elite housing. Analysis using Soerjono Soekanto’s indicators shows that the effectiveness of this law's implementation is influenced by several factors. The legal factor provides a strong basis for BPS in exercising its authority; the law enforcement factor involves BPS in optimizing community participation; and the facility or infrastructure factor plays an important role, especially concerning limited resources affecting census effectiveness. Additionally, the community factor faces low participation due to limited socialization, while the cultural factor encompasses various public perspectives that also influence participation levels. In conclusion, BPS Tangerang City has carried out its attributive authority according to Law No. 16 of 1997. However, the law’s effectiveness has shown improvement, though not fully optimal, with the online method introduced in the 2020 census, which succeeded in expanding coverage but still faced access challenges in some areas. As a recommendation, BPS needs to enhance socialization on the importance of the census, strengthen online census methods, and conduct periodic evaluations of census methods to improve public participation and data accuracy.

Fokus utama penelitian ini adalah: Bagaimana pelaksanaan kewenangan BPS Kota Tangerang dalam penyelenggaraan Sensus Penduduk berdasarkan Undang-Undang Nomor 16 Tahun 1997? dan Apa saja hambatan yang dihadapi BPS Kota Tangerang dalam penyelenggaraan Sensus Penduduk berdasarkan undang-undang tersebut? Penelitian ini menggunakan Teori Kewenangan dan Teori Efektivitas Hukum, dengan metode yuridis empiris serta pendekatan deskriptif kualitatif. Sumber data adalah data primer yang didukung oleh data sekunder, dan teknik pengumpulan data dilakukan melalui wawancara. Hasil penelitian menunjukkan bahwa BPS Kota Tangerang telah menjalankan kewenangannya dengan baik melalui berbagai inovasi, seperti metode sensus online dan sensus lapangan. Namun, beberapa hambatan tetap dihadapi, seperti rendahnya partisipasi masyarakat dan tantangan pengumpulan data di wilayah tertentu, khususnya perumahan elit. Analisis menggunakan indikator Soerjono Soekanto menunjukkan bahwa efektivitas pelaksanaan undang-undang ini dipengaruhi oleh beberapa faktor. Faktor hukum menyediakan dasar kuat bagi BPS dalam menjalankan kewenangannya; faktor penegak hukum melibatkan BPS dalam mengupayakan partisipasi optimal masyarakat; dan faktor sarana atau fasilitas berperan penting, terutama terkait keterbatasan sumber daya yang memengaruhi efektivitas pelaksanaan sensus. Selain itu, terdapat faktor masyarakat yang menghadapi kendala partisipasi rendah akibat sosialisasi yang terbatas, serta faktor kebudayaan yang mencakup berbagai pandangan masyarakat yang turut memengaruhi tingkat partisipasi. Kesimpulannya, BPS Kota Tangerang telah melaksanakan kewenangan atributifnya sesuai dengan Undang-Undang Nomor 16 Tahun 1997. Namun, efektivitas undang-undang ini menunjukkan peningkatan yang belum sepenuhnya optimal dengan adanya metode online pada sensus 2020, yang berhasil memperluas cakupan tetapi masih menghadapi tantangan akses di beberapa wilayah. Sebagai saran, BPS perlu meningkatkan sosialisasi tentang pentingnya sensus, memperkuat metode sensus online, serta melakukan evaluasi berkala terhadap metode sensus guna meningkatkan partisipasi masyarakat dan akurasi data. | |||||||||
