Abstract
Implementation of auctions with objects in the form of the right to enjoy goods is a breakthrough from DJKN as the auction regulator in Indonesia by diversifying auction objects that have special characteristics, namely intangible objects that have a certain period of time. The types of auctions that are included in the scope of auctions with objects in the form of rights to enjoy goods are mandatory non-execution auctions and voluntary auctions so that the biggest target of this auction is the auction of utilization rights of State/Regional Property managed by central and regional government agencies. However, there are still many government agencies that do not use auctions to find prospective tenants of their assets, and some even carry out auctions of enjoying rights, but without going through the KPKNL. The purpose of this research is to explain and analyze the conformity of the implementation of the auction with the object in the form of the right to enjoy (land and/or building rental rights) of State/Regional Property which is carried out at the Tangerang II KPKNL based on Minister of Finance Regulation number 213/PMK.06/2020 concerning Instructions Implementation of Auctions and to find out and explain the validity of auctions with objects in the form of rights to enjoy (land and/or building rental rights) of State/Regional Property which are carried out without going through the KPKNL. The research method used in this study is normative with a statutory approach taken from secondary data and primary data. The results of research related to auctions with objects in the form of the right to enjoy goods are still not attractive to government agencies that use BMN/D, especially BMN/BMD leases. One of the reasons for the lack of interest in auctions with objects in the form of the right to enjoy this item is the lack of socialization from the KPKNL as the auctioneer, the DJKN Regional Office as the supervisor and the DJKN itself as the auction regulator. It is hoped that the government can strengthen the functions of state and private auction organizers in drafting or amending laws and regulations for the certainty and effectiveness of the applicable law.

Additional Information: | Pelaksanaan lelang dengan objek berupa hak menikmati barang merupakan suatu terobosan dari DJKN sebagai regulator lelang di Indonesia dengan melakukan diversifikasi objek lelang yang memiliki karakteristik khusus yaitu benda tak berwujud yang memiliki perioditas jangka waktu tertentu. Jenis lelang yang masuk ke dalam cakupan lelang dengan objek berupa hak menikmati barang adalah lelang noneksekusi wajib dan lelang sukarela sehingga target terbesar pelaksanaan lelang ini adalah lelang hak pemanfaatan Barang Milik Negara / Daerah yang dikelola oleh instansi pemerintahan pusat maupun daerah. Namun masih banyak instansi pemerintahan yang tidak menggunakan lelang untuk mencari calon penyewa asetnya bahkan ada yang melaksanakan lelang hak menikmati namun tanpa melalui KPKNL. Tujuan penelitian ini adalah ntuk menjelaskan dan menganalisis kesesuaian pelaksanaan lelang dengan objek berupa hak menikmati (hak sewa tanah dan/atau bangunan) Barang Milik Negara/Daerah yang dilakukan di KPKNL Tangerang II berdasarkan Peraturan Menteri Keuangan nomor 213/PMK.06/2020 tentang Petunjuk Pelaksanaan Lelang dan untuk mengetahui dan menjelaskan keabsahan lelang dengan objek berupa hak menikmati (hak sewa tanah dan/atau bangunan) Barang Milik Negara/Daerah yang dilaksanakan tanpa melalui KPKNL. Metode penelitian yang digunakan dalam penelitian ini adalah normatif dengan pendekatan peraturan perundang-undangan yang diambil dari data sekunder dan data primer. Hasil penelitian terkait lelang dengan objek berupa hak menikmati barang masih kurang diminati oleh instansi pemerintahan yang melakukan pemanfaatan BMN/D khususnya sewa BMN/BMD. Salah satu penyebab kurang diminatinya lelang dengan objek berupa hak menikmati barang ini adalah kurangnya sosialisasi dari KPKNL selaku pelaku lelang, Kanwil DJKN selaku pengawas maupun DJKN sendiri selaku regulator lelang. Diharapkan pemerintah dapat mempertegas fungsi penyelenggara lelang negara maupun swasta dalam penyusunan atau perubahan aturan perundang-undangan demi kepastian dan efektivitas hukum yang berlaku. | |||||||||
