Abstract
The Honorary Board of Election Organizers (DKPP) is one of the election organizers who has a noble task, namely enforcing the code of ethics of election organizers. Article 22E paragraph (5) of the 1945 Constitution states that “The general election is held by a General Election Commission that is national, permanent, and independent”. In Law Number 7 of 2017 concerning General Elections, Article 163 paragraph (1) explains “The DKPP Secretariat is led by a secretary”. Identification of problems in this study 1) How is the conception of the independence of the Honorary Council of General Election Organizers (DKPP) as a single function of election organizers reviewed from the 1945 Constitution?. 2) What is the implication of the position of the Secretary of the Honorary Council of the General Election Organizer (DKPP) under the Ministry of Home Affairs on the independence of the implementation of the duties and authority of the DKPP in enforcing the code of ethics of election organizers?. The theory used in this research is the Theory of Institutional Independence and the Theory of the State of Law. The method used in this research is normative juridical (normative legal research) and empirical juridical, which is legal research conducted by researching Library materials or secondary data and primary data. Based on the results of the research, it was concluded that the DKPP Secretariat was led by a secretary. The Secretary of DKPP is appointed and dismissed by the Minister of Home Affairs and is responsible to the Chairman of the DKPP. There is a regulation regarding the Secretary of DKPP so that it can carry out its duties and functions independently and so that the structural position of secretary of DKPP is raised to echelon 1.

| Additional Information: | Dewan Kehormatan Penyelenggara Pemilu (DKPP) merupakan salah satu penyelenggara pemilu yang memiliki tugas mulia yakni menegakkan kode etik penyelengara pemilu. Pasal 22E ayat (5) UUD 1945 menyebutkan bahwa “Pemilihan umum diselenggarakan oleh suatu Komisi Pemilihan Umum yang bersifat nasional, tetap, dan mandiri”. Dalam UU Nomor 7 Tahun 2017 Tentang Pemilihan Umum, Pasal 163 ayat (1) menjelaskan “Sekretariat DKPP dipimpin oleh seorang sekretaris”. Identifikasi masalah dalam penelitian ini 1) Bagaimana konsepsi kemandirian Dewan Kehormatan Penyelenggara Pemilihan umum (DKPP) sebagai satu kesatuan fungsi penyelenggara pemilu ditinjau dari UUD 1945?. 2) Bagaimana implikasi kedudukan Sekretaris Dewan Kehormatan Penyelenggara Pemilihan umum (DKPP) di bawah Kemendagri terhadap kemandirian pelaksanaan tugas dan wewenang DKPP dalam menegakkan kode etik penyelenggara pemilu?. Teori yang digunakan dalam penelitian ini yakni Teori Kemandirian Kelembagaaan dan Teori Negara Hukum. Metode yang digunakan dalam penelitian ini yuridis normative (penelitian hukum normatif) dan yuridis empiris, yaitu penelitian hukum yang dilakukan dengan meneliti bahan Pustaka atau data sekunder dan data primer. Berdasarkan hasil penelitian diperoleh kesimpulan bahwa Sekretariat DKPP dipimpin oleh seorang sekretaris. Sekretaris DKPP tersebut diangkat dan diberhentikan oleh Menteri Dalam Negeri dan bertanggung jawab kepada Ketua DKPP. Kesimpulannya bahwa Sekretaris DKPP tersebut diangkat dan diberhentikan oleh Menteri Dalam Negeri dan bertanggung jawab kepada Ketua DKPP. Adanya pengaturan mengenai Sekretaris DKPP agar dapat menjalankan tugas dan fungsinya secara mandiri dan agar dinaikan jabatan struktural sekretaris DKPP menjadi eselon 1. | |||||||||
