Abstract

International law regulates every relationship between international subjects, including the obligation to return cultural heritage objects confiscated from their country of origin. Indonesia as a country that is a victim of the confiscation of cultural heritage objects has an interest in reclaiming its rights to restitution, while the Netherlands as the responsible party is burdened with the obligation to make reparations in the form of restitution. There are two identifications of problems that arise, namely: how international law regulates the return of cultural heritage objects to their country of origin, and how international law views the return of Indonesian cultural heritage objects by the Netherlands. The Theory of Compliance in International Law and the Theory of State Responsibility are the basic theories used by researchers. This research was conducted using a normative legal research method and using literature studies as research materials and analyzed with qualitative normative analysis. The results of this study can be concluded that there is no international convention that specifically regulates the return of cultural heritage objects taken during the colonial period. Even so, the developing customary international law shows that countries responsible for the confiscation of cultural heritage objects are burdened with the obligation of restitution, including the Netherlands which has not returned some of Indonesia's cultural heritage objects. The Netherlands' refusal to return the Java Man fossil is not in accordance with international law because the Netherlands has not fully complied with the principle of restitutio in integrum. Based on this conclusion, the researcher provides several suggestions, namely: Both countries should work together to explore other options besides return and sign a return policy that can be agreed upon by both countries.

Additional Information: Hukum internasional mengatur setiap hubungan antar subjek internasional, termasuk kewajiban pengembalian benda cagar budaya yang dirampas dari negara asalnya. Indonesia sebagai negara korban perampasan benda cagar budaya memiliki kepentingan untuk meminta kembali haknya atas restitusi, sedangkan Belanda sebagai pihak yang bertanggungjawab dibebankan kewajiban untuk melakukan reparasi dalam bentuk restitusi. Terdapat dua identifikasi masalah yang muncul, yaitu: bagaimana pengaturan pengembalian benda cagar budaya ke negara asalnya menurut hukum internasional, dan bagaimana pengembalian benda cagar budaya Indonesia oleh Pemerintah Belanda menurut hukum internasional. Teori Kepatuhan Dalam Hukum Internasional dan Teori Tanggung Jawab Negara menjadi teori dasar yang peneliti gunakan. Penelitian ini dilakukan dengan menggunakan metode penelitiaan yuridis normatif dan dengan menggunakan studi kepustakaan sebagai bahan penelitian dan dianalisa dengan analisa normatif kualitatif. Hasil dari penelitian ini dapat disimpulkan bahwa, belum ada konvensi internasional yang secara khusus mengatur mengenai pengembalian benda cagar budaya yang diambil pada masa kolonial. Meski begitu, hukum kebiasaan internasional yang berkembang menunjukkan bahwa negara-negara yang bertanggungjawab atas perampasan benda cagar budaya dibebankan kewajiban berupa restitusi, termasuk Belanda yang belum mengembalikan sebagian benda cagar budaya Indonesia. Penolakan Belanda dalam mengembalikan fosil Manusia Jawa adalah tidak sesuai dengan hukum internasional karena Belanda belum sepenuhnya patuh terhadap asas restitutio in integrum. Berdasarkan kesimpulan tersebut, peneliti memberikan beberapa saran, yaitu: Kedua negara agar bekerja sama dalam mengeksplorasi opsi lain selain pengembalian dan menandatangani return policy yang dapat disepakati oleh kedua negara.
