Abstract
Insurance arrangements in Indonesia are regulated in Law No. 40 of 2014 concerning Insurance. In practice in the community there are often problems related to insurance claims such as obstacles in obtaining payment of insurance claims, and as a result of the non-transparency of information provided at the beginning by insurance agents causing misunderstanding of information, as in the case of Policyholders at PT AIA Financial Provisa Syari'ah Unitlink Insurance Serang City. This research was conducted to find out the legal protection for insurance policyholders in the non-transparency of insurance policy information based on Law No. 40 of 2014 concerning insurance and to find out the legal settlement by the Company in the customer's insurance claim that is not suitable due to the non-transparency of insurance policy information related to Law No. 40 of 2014 concerning insurance. The theory used is the theory of legal protection and justice. The method used, qualitative method with normative juridical approach. The data used is sourced from primary data and secondary data. The results showed that legal protection of policyholders includes preventive and repressive aspects, Regulations of Law No. 40 of 2014 concerning Insurance and various OJK Regulations, emphasizing the importance of consumer protection, information transparency, and fairness in insurance agreements. Policyholders have rights that must be protected, including the right to honest and clear information. Regulations related to insurance dispute resolution are regulated in Law No. 40 of 2014 and other OJK Regulations. In addition, the settlement of insurance dispute resolution requires a fair, transparent, and efficient approach, both through litigation and non-litigation channels, to ensure the rights and obligations of all parties are fulfilled in accordance with the applicable agreement. In this case the insurance claim was settled through negotiation.

Pada praktiknya di masyarakat sering terdapat masalah terkait klaim asuransi seperti kendala dalam memperoleh pembayaran klaim asuransi, dan akibat dari ketidaktransparanan informasi yang diberikan diawal oleh agen asuransi menyebabkan salah paham atas informasi, seperti dalam kasus Pemegang Polis di PT. AIA Financial Asuransi Unitlink Provisa Syari’ah Kota Serang. Penelitian ini dilakukan Untuk mengetahui perlindungan hukum bagi pemegang polis asuransi dalam ketidaktransparanan informasi polis asuransi berdasarkan UU No. 40 tahun 2014 tentang perasuransian dan untuk mengetahui penyelesaian hukum oleh Perusahaan dalam klaim asuransi nasabah yang tidak sesuai akibat ketidaktransparanan informasi polis asuransi dihubungkan dengan UU No. 40 tahun 2014 tentang perasuransian. Teori yang digunakan teori perlindungan hukum dan keadilan. Metode yang digunakan, metode kualitatif dengan pendekatan yuridis normatif. Data yang digunakan bersumber dari data primer dan data sekunder. Hasil penelitian menunjukan Perlindungan hukum terhadap pemegang polis ini mencakup aspek preventif dan represif, Peraturan UU No. 40 Tahun 2014 tentang Perasuransian dan berbagai Peraturan OJK, menekankan pentingnya perlindungan konsumen, transparansi informasi, dan keadilan dalam perjanjian asuransi. Pemegang polis memiliki hak-hak yang harus dilindungi, termasuk hak atas informasi yang jujur dan jelas. Regulasi terkait penyelesaian sengketa asuransi diatur dalam UU No. 40 Tahun 2014 dan Peraturan OJK lainnya. Selain itu, penyelesaian Penyelesaian sengketa asuransi memerlukan pendekatan yang adil, transparan, dan efisien, baik melalui jalur litigasi maupun non-litigasi, untuk memastikan hak dan kewajiban semua pihak terpenuhi sesuai dengan perjanjian yang berlaku. Dalam kasus ini klaim asuransi diselesaikan melalui negosiasi. | |||||||||
