Abstract

Ship piracy is considered to still be an enemy of humanity because it is very detrimental. One example is the hijacking of the Galaxy Leader ship which occurred in November 2023, which was carried out by the Yemeni Houthi group. Article 100 of UNCLOS 1982 states that countries must work together to prevent ship piracy in international seas, thereby creating responsibility for countries that ratify UNCLOS 1982, including the country of Yemen. The responsibility of the Yemeni state is also supported by Article 44 of UNCLOS 1982 concerning the prohibition on a country directly bordering the strait from obstructing transit traffic. However, the Yemeni state has still not taken any action to resolve the Galaxy Leader ship hijacking incident, so the Yemeni state is not considered responsible for the piracy incident. However, according to the principle of due diligence, a country can be said to have fulfilled its responsibility if it has made the smallest effort to prevent an international violation from occurring. This then raises the question of how responsible a country is for ship hijacking incidents. This research is included in the type of normative research and uses primary legal materials, secondary legal materials and tertiary legal materials. The results of this research are the discovery of elements that strengthen that the Yemeni state has carried out its responsibilities. This is because Yemen has made efforts to prevent piracy incidents. Moreover, the perpetrator of this incident is a Yemeni rebel group and has controlled parts of Yemen. However, Yemen is considered to still have to take firm action against this piracy.

Additional Information: Pembajakan kapal dinilai masih menjadi musuh umat manusia karena sangat merugikan. Salah satu contohnya pembajakan kapal Galaxy Leader yang terjadi pada bulan November 2023 yang dilakukan oleh kelompok Houthi Yaman. Pasal 100 UNCLOS 1982 menyebutkan bahwa negara-negara harus bekerja sama dalam rangka pencegahan pembajakan kapal di laut internasional, sehingga menimbulkan tanggung jawab bagi negara-negara yang meratifikasi UNCLOS 1982, termasuk negara Yaman. Tanggung jawab negara Yaman juga didukung oleh adanya Pasal 44 UNCLOS 1982 tentang pelarangan bagi suatu negara yang berbatasan langsung dengan selat untuk menghambat lintas transit. Namun, negara Yaman masih belum melakukan tindakan apapun dalam menyelesaikan insiden pembajakan kapal Galaxy Leader, sehingga negara Yaman dinilai tidak bertanggung jawab atas insiden pembajakan tersebut. Akan tetapi, menurut prinsip due diligence, suatu negara dapat dikatakan telah menunaikan tanggung jawabnya jika sudah melakukan upaya terkecil untuk mencegah terjadinya suatu pelanggaran internasional. Hal tersebut kemudian menimbulkan pertanyaan bagaimana tanggung jawab suatu negara atas adanya insiden pembajakan kapal. Penelitian ini termasuk kedalam jenis penelitian normatif dan menggunakan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil dari penelitian ini adalah ditemukannya unsur-unsur yang menguatkan bahwa negara Yaman telah melakukan tanggung jawabnya. Hal tersebut dikarenakan Yaman telah melakukan upaya-upaya pencegahan atas insiden pembajakan. Terlebih lagi, pelaku dari insiden ini merupakan kelompok pemberontak negara Yaman dan telah menguasai sebagian negara Yaman. Namun, Yaman dinilai masih harus melakukan tindakan tegas atas pembajakan ini.
