Abstract
The Regional People's Representative Council is the people's representatives who are directly elected through general elections in accordance with the provisions of article 22E paragraph (2) of the 1945 Constitution of the Republic of Indonesia. Papua Province is one of the provinces that is given special autonomy with one of the specialties being members of the Regional People's Representative Council through an appointment mechanism from independent people or Indigenous Papuans (OAP). Identify the problems in this research, namely: first, what is the existence of the appointed members of the Papuan People's Representative Council from the perspective of representative democracy?; second, what is the impact of the presence of appointed members of the Papuan People's Representative Council (DPRP) on the representation of tribal groups in the process of making Regional Regulations? The research carried out is a normative juridical research type with a statutory approach, a historical approach and a case approach. This research uses secondary data, which consists of primary legal materials, secondary legal materials and tertiary legal materials. The research results showed that: first, the DPRP members appointed were collective representatives of indigenous communities. As a collective representative of indigenous communities, the Tribal Chief as chairman of the indigenous community is not involved in the DPRP member selection process for the appointment mechanism for the 2014-2019 and 2019-2024 periods. Only in the 2024-2029 period, the Tribal Head will be involved in the selection process by sending the names of delegates who will then be selected by the Provincial Selection Committee; secondly, DPRP members come from Papua's traditional areas, namely La Pago, Mee Pago, Ha Anim, Tabi and Saireri. DPRP members by appointment mechanism have the same authority, rights and obligations as DPRP members through elections. There were 6 Perdasus made in the 2014- 2024 period. With the regional regulations that address special handling for the development of isolated, remote and neglected tribes, there are 2 regional regulations, namely Regional Regulation Number 8 of 2014 concerning Special Handling for Remote Indigenous Communities and Regional Regulation Number 10 of 2014 concerning Strategic Programs for Village Economic and Institutional Development.

Additional Information: | Dewan Perwakilan Rakyat Daerah adalah perwakilan rakyat yang dipilih langsung melalui pemilihan umum sesuai ketentuan pasal 22E ayat (2) UUD NRI 1945. Provinsi Papua merupakan salah satu provinsi yang diberikan otonomi khusus dengan salah satu kekhususan adanya anggota Dewan Perwakilan Rakyat Daerah melalui mekanisme pengangkatan dari indegeonus people atau Orang Asli Papua (OAP). Identifikasi masalah dalam penelitian ini, yaitu: pertama, bagaimana eksistensi anggota Dewan Perwakilan Rakyat Papua yang diangkat dalam perspektif demokrasi perwakilan?; kedua, bagaimana dampak keberadaan anggota Dewan Perwakilan Rakyat Papua (DPRP) yang diangkat dari keterwakilan kelompok Suku terhadap pembentukan Peraturan Daerah Khusus (Perdasus)? Penelitian yang dilakukan adalah tipe penelitian yuridis normatif dengan pendekatan perundang-undangan, pendekatan histori, dan pendekatan kasus. Penelitian ini menggunakan data sekunder, yang terdiri atas bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian diperoleh bahwa: pertama, anggota DPRP yang diangkat merupakan perwakilan kolektif masyarakat adat. Sebagai perwakilan kolektif masyarakat adat, Kepala Suku sebagai ketua masyarakat adat tidak dilibatkan dalam proses seleksi anggota DPRP mekanisme pengangkatan periode 2014-2019 dan periode 2019-2024. Baru pada periode 2024-2029, Kepala Suku dilibatkan dalam proses seleksi dengan mengirimkan nama utusan yang kemudian akan diseleksi oleh Panitia Seleksi Provinsi; kedua, anggota DPRP berasal dari wilayah adat papua yaitu La Pago, Mee Pago, Ha Anim, Tabi dan Saireri. Anggota DPRP mekanisme pengangkatan memiliki kewenangan, hak dan kewajiban yang sama dengan anggota DPRP melalui pemilu. Perdasus yang dibuat dalam periode 2014- 2024 yaitu sebanyak 6 Perdasus. Dengan perdasus yang mengangkat terkait Penanganan khusus bagi pengembangan suku-suku terisolasi, terpencil dan terabaikan berjumlah 2 perdasus yaitu Perdasus Nomor 8 Tahun 2014 Tentang Penanganan Khusus Terhadap Komunitas Adat Terpencil dan Perdasus Nomor 10 Tahun 2014 Tentang Program Strategis Pembangunan Ekonomi dan Kelembagaan Kampung | |||||||||
