Abstract
An agreement is regulated in Article 1313 of the Civil Code, which is an act in which one or more persons bind themselves to one or more other persons. In this agreement, there is a dispute between PT. MODERN INDUSTRIAL ESTATE with PT. GERBANG NUSANTARA. This thesis aims to find out how the judge's decision to reject the lawsuit for Onrecht (Onrechtmatige Daad) in the termination of cooperation is in accordance with the applicable legal provisions. This type of research is Normative Juridical. The approach in this writing is that the author seeks to review and analyze the Serang District Court Decision Number: 134/Pdt.G/2022/PN.Srg. Based on relevant laws and regulations and decisions as a reference to solve the problems written in the thesis. This writing uses primary data and secondary data. Data analysis uses deductive analysis techniques. The location of the research is located at the Serang District Court, Sultan Ageng Tirtayasa University Library. The results of this study show that in the lawsuit it is an act of default, not an Onrecht (Onrechtmatige Daad) where this previously occurred cooperation that gave rise to an agreement that had been agreed upon by both parties.

| Additional Information: | Pengelola parkir bukan merupakan perusahaan asuransi, melainkan perusaan jasa yang mengelola lahan parkir disuatu area properti, dengan cara bekerjasama dengan pemilik area lahan tersebut, dalam hal tersebut timbulah suatu perikatanantara pemilik lahan parkir dengan pengelola lahan parkir. Perjanjian diatur dalam Pasal 1313 KUH Perdata yaitu suatu perbuatan di mana satu orang atau lebih mengikatkan dirinya terhadap satu orang lain atau lebih. Dalam perjanjian ini terdapat sengketa antara PT. Modern Industrial Eestate dengan PT. Gerbang Nusantara. Skripsi ini bertujuan untuk mengetahui bagaimana putusan hakim yang menolak gugatan Perbuatan Melawan Hukum (MPH) dalam pemutusan hubungan kerjasama apakah telah sesuai dengan ketentuan hukum yang berlaku. Jenis Penelitian ini adalah Yuridis Normatif. Pendekatan dalam penulisan ini penulis berusaha untuk mengkaji dan menganalisis Putusan Pengadilan Negeri Serang Nomor: 134/Pdt.G/2022/PN.Srg. Berdasarkan peraturan perundang-undangan dan putusan yang terkait sebagai acuan untuk memecahkan masalah yang di tulis dalam skripsi. Penulisan ini menggunakan data primer dan data sekunder. Analisis data menggunakan teknik analisis deduktif. Lokasi penelitian bertempat di Pengadilan Negeri Serang, Perpustakaan Universitas Sultan Ageng Tirtayasa. Hasil penelitian ini menunjukkan bahwa dalam gugatan tersebut merupakan suatu perbuatan wanprestasi bukan suatu perbuatan melawan hukum (MPH) dimana hal ini sebelumnya terjadi kerjasama yang menimbulkan suatu perjanjian yang telah disepakati oleh kedua belah pihak. | |||||||||
