Abstract
The occurrence of the Covid-19 pandemic increases the risk to the health of Hajj pilgrims, where Hajj pilgrims are more vulnerable to health problems because the Covid-19 virus is a type of virus that causes infections of the nose, sinuses, or upper throat and can be easily transmitted through the air by coughing or sneezing and also direct contact such as shaking hands, so that the Ministry of Religious Affairs and PT Takaful Keluarga should also be able to provide health insurance benefits for Hajj pilgrims who experience health problems while performing the pilgrimage. The problems in this study are how the implementation of insurance protection for Indonesian Hajj pilgrims after the Covid-19 pandemic by the Ministry of Religion, and how the form of insurance protection for Indonesian Hajj pilgrims after the Covid-19 pandemic carried out by the Ministry of Religion. The type of research used is normative legal research, using a statutory approach and conceptual approach, and data sources obtained from secondary, primary, and tertiary data. The data collection technique used is by means of documentation studies and interviews, then the data collected is analyzed qualitatively. The results of the study found that: 1) The implementation of insurance protection for Indonesian Hajj pilgrims after the Covid-19 pandemic by the Ministry of Religious Affairs is not in accordance with the provisions mandated in Article 80 paragraph (1) letter d and Article 81 paragraph (1) of Law Number 8 of 2019. Article 80 paragraph (1) letter d states that Hajj pilgrims receive life, accident, and health protection. Furthermore, Article 81 paragraph (1) states that the protection of life, accident, and health as referred to in Article 80 paragraph (1) letter d is provided in the form of insurance. The occurrence of the Covid-19 pandemic increases the risk to the health of Hajj pilgrims, where Hajj pilgrims are more vulnerable to health problems due to the Covid-19 virus; 2) The form of insurance protection for Indonesian Hajj pilgrims after the Covid19 pandemic carried out by the Ministry of Religion only provides protection in the form of life insurance in the form of death, accidents, and disability due to accidents, but does not provide health insurance to Hajj pilgrims, so this is contrary to Article 80 paragraph (1) letter d and Article 81 paragraph (1) of Law Number 8 of 2019 concerning the Implementation of Hajj and Umrah.

| Additional Information: | Terjadinya pandemi Covid-19 meningkatkan risiko terhadap kesehatan Jemaah Haji, di mana Jemaah Haji lebih rentan terganggu kesehatannya karena virus Covid-19 ini merupakan sejenis virus yang menyebabkan infeksi pada hidung, sinus, atau tenggorokan bagian atas dan dapat dengan mudah menular melalui udara dengan batuk atau bersin dan juga kontak langsung seperti berjabat tangan, sehingga seharusnya Kementerian Agama dan PT. Takaful Keluarga juga dapat memberikan santunan asuransi kesehatan bagi Jemaah Haji yang mengalami gangguan kesehatan saat melaksanakan ibadah haji. Permasalahan dalam penelitian ini yaitu bagaimana pelaksanaan perlindungan asuransi terhadap Jemaah Haji Indonesia pasca pandemi Covid-19 oleh Kementerian Agama, serta bagaimana bentuk perlindungan asuransi terhadap Jemaah Haji Indonesia pasca pandemi Covid-19 yang dilakukan oleh Kementerian Agama. Adapun jenis penelitian yang digunakan yaitu penelitian hukum normatif, dengan menggunakan pendekatan undang-undang dan pendekatan konseptual, serta sumber data yang diperoleh dari data sekunder, primer, dan tersier. Teknik pengumpulan data yang dilakukan yaitu dengan cara studi dokumentasi dan wawancara, kemudian data yang terkumpul dianalisis secara kualitatif. Hasil penelitian ditemukan bahwa: 1) Pelaksanaan perlindungan asuransi terhadap jemaah haji Indonesia pasca pandemi Covid-19 oleh Kementerian Agama belum sesuai dengan ketentuan yang diamanatkan dalam Pasal 80 ayat (1) huruf d dan Pasal 81 ayat (1) UndangUndang Nomor 8 Tahun 2019. Pasal 80 ayat (1) huruf d menyatakan bahwa Jemaah haji mendapatkan perlindungan jiwa, kecelakaan, dan kesehatan. Lebih lanjut dalam Pasal 81 ayat (1) dikatakan bahwa perlindungan jiwa, kecelakaan, dan kesehatan sebagaimana dimaksud dalam Pasal 80 ayat (1) huruf d diberikan dalam bentuk asuransi. Terjadinya pandemi Covid-19 meningkatkan risiko terhadap kesehatan Jemaah Haji, di mana Jemaah Haji lebih rentan terganggu kesehatannya karena virus Covid-19; 2) Bentuk perlindungan asuransi terhadap jemaah haji Indonesia pasca pandemi Covid-19 yang Dilakukan oleh Kementrian Agama hanya memberikan perlindungan berupa asuransi jiwa berupa kematian, kecelakaan, dan cacat akibat kecelakaan saja, tetapi tidak memberikan asuransi kesehatan kepada Jemaah Haji, sehingga hal ini bertentangan dengan Pasal 80 ayat (1) huruf d dan Pasal 81 ayat (1) Undang-Undang Nomor 8 Tahun 2019 tentang Penyelenggaraan Ibadah Haji dan Umrah. | |||||||||
