Abstract

This thesis discusses the dispute originating from the East Jakarta District Court Decision Case Number 133/Pdt.G/2018/Pn.Jkt.Tim, namely regarding the sale and purchase of land with a sale and purchase deed where the payment was not paid in full as well as the relinquishment of rights as a way of acquiring land . The author tries to discuss the problem that the author is researching, there is a transfer of rights through a legal act of sale and purchase, and a deed of sale and purchase has been made, but the payment has not been paid in full, or only partially, then after that, there is an attempt by a third party to obtain the disputed land object by means of a release event. right. The issues raised are 1) what is the validity of the sale and purchase of land with a sale and purchase deed where the payment was not paid in full in Decision number 133/Pdt.G/2018/PN.Jkt.Tim.? What are the legal consequences of releasing land rights by making a private release agreement by making an agreement to release rights privately in Decision number 133/Pdt.G/2018/PN.Jkt.Tim.? The research method used in the research is a form of normative juridical research, namely conducting research on positive law by taking an approach that refers to legal norms contained in statutory regulations and is assisted by library materials related to the problems discussed in this research. Based on the results of this research, the Panel of Judges explained that the nature of the sale and purchase which only stated "Cash", had been fulfilled because it was carried out before the PPAT by making a Deed of Sale and Purchase Number 220/2006. However, the Panel of Judges did not explain the nature of the "cash" sale and purchase of the disputed land object obtained by a third party through a relinquishment of rights, where the relinquishment of rights should have been carried out first through a land institution and then had to be followed by an application for new rights in accordance with its intended purpose. Procedures related to the release of rights must be carried out through the land agency, then an application for new rights must be followed, then land can be obtained/owned by those who need land.

Additional Information: Skripsi ini membahas mengenai sengketa yang berasal dari Putusan Pengadilan Negeri Jakarta Timur Nomor Perkara 133/Pdt.G/2018/PN.Jkt.Tim yaitu mengenai jual beli tanah dengan akta jual beli yang pembayarannya ternyata tidak lunas serta acara pelepasan hak sebagai cara memperoleh tanah. Penulis mencoba membahas permasalahan yang penulis teliti, terjadi peralihan hak dengan perbuatan hukum jual beli, dan telah dibuat akta jual beli, namun pembayarannya belum lunas, atau baru sebagian, kemudian setelah itu, terjadi upaya dari pihak ketiga untuk memperoleh tanah obyek sengketa dengan acara pelepasan hak. masalah yang diangkat: 1) Bagaimana keabsahan jual beli tanah dengan akta jual beli yang pembayarannya ternyata tidak lunas dalam Putusan nomor 133/Pdt.G/2018/PN.Jkt.Tim.? Bagaimana akibat hukum pelepasan hak atas tanah dengan membuat perjanjian pelepasan hak dibawah tangan dalam Putusan nomor 133/Pdt.G/2018/PN.Jkt.Tim.? Metode penelitian yang digunakan dalam penelitian adalah bentuk penelitian yuridis normatif, yaitu melakukan penelitian terhadap hukum positif dengan melakukan pendekatan yang mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan dan dibantu dengan bahan pustaka yang berkaitan dengan permasalahan yang dibahas dalam penelitian ini. Berdasarkan hasil penelitian ini Majelis Hakim menjelaskan sifat jual beli yang hanya menyatakan “Tunai”, sudah terpenuhi karena dilakukan dihadapan PPAT dengan membuat Akta Jual Beli Nomor 220/2006. Namun Majelis Hakim tidak memaparkan mengenai sifat jual beli “Tunai” Tanah obyek sengketa yang diperoleh pihak ketiga dengan acara pelepasan hak, yang dimana seharusnya pelepasan hak harus dilakukan terlebih dahulu lewat lembaga pertanahan dan kemudian harus diikuti dengan permohonan hak yang baru yang sesuai dengan peruntukannya. Prosedur terkait pelepasan hak yang harus dilakukan lewat lembaga pertanahan, kemudian harus diikuti permohonan hak yang baru, barulah tanah yang dapat diperoleh/miliki yang memerlukan tanah.
