Abstract
The National Land Agency as an institution that carries out tasks in the land sector nationally. The rampant land disputes in Cilegon City caused by overlapping land have resulted in the community feeling disadvantaged and expecting a resolution of land disputes that results in a "win-win solution" through mediation at the Cilegon City Land Office. Based on this background, it is necessary to study the role and authority of the national land agency as a mediator in resolving overlapping land disputes in Cilegon City? And what are the obstacles faced by the national land agency in resolving overlapping land disputes in Cilegon City? The theory used is the theory of legal certainty. The method used is empirical juridical supported by normative juridical research, with research specifications in the form of analytical descriptive, data sources in the form of primary data and secondary data, data collection techniques in the form of field research (interviews) and library research, data analysis using qualitative, and the location of the research at the Cilegon City Land Office. The results of this study indicate that the role of the National Land Agency in resolving land disputes by receiving public complaints, then collecting data and analyzing disputes, and reviewing and conducting field inspections. Then issuing a dispute resolution decision if there is evidence of administrative defects. In addition, facilitating mediation for the disputing parties. The results of the mediation are made into a Peace Agreement, Inhibiting factors in resolving land disputes through mediation at the Cilegon City Land Office, namely parties who do not have good intentions to use the mediation process as a way to waste time, pretend to forget or are dishonest in resolving disputes. Low level of participation of the disputing parties in resolving land disputes. There is a transfer of technology from analog certificates to electronic certificates.

Maraknya sengketa tanah di Kota Cilegon yang disebabkan oleh tumpang tindih tanah (overlapping) mengakibatkan masyarakat merasa terugikan dan mengharapkan adanya penyelesaian sengketa pertanahan yang menghasilkan “win-win solution” dengan cara mediasi di Kantor Pertanahan Kota Cilegon. Berdasarkan latar belakang tersebut perlu dikaji mengenai Bagaimana peran dan wewenang badan pertanahan nasional sebagai mediator dalam penyelesaian sengketa pertanahan tumpang tindih (overlapping) di Kota Cilegon? Dan apa hambatan yang dihadapi badan pertanahan nasional dalam penyelesaian sengketa pertanahan tumpang tindih (overlapping) di Kota Cilegon? Teori yang digunakan adalah teori kepastian hukum. Metode yang digunakan adalah yuridis empiris didukung dengan penelitian yuridis normatif, dengan spesifikasi penelitian berupa deskriptif analitis, sumber datanya berupa data primer dan data sekunder, teknik pengumpulan data berupa penelitian lapangan (wawancara) dan penelitian kepustakaan, analisis datanya menggunakan kualitatif, dan lokasi penelitiannya di kantor pertanahan Kota Cilegon. Hasil penelitian ini menunjukkan bahwa peran Badan Pertanahan Nasional dalam penyelesaian sengketa pertanahan dengan menerima pengaduan masyarakat, kemudian mengumpulkan data dan menganalisis sengketa, serta mengkaji dan melakukan pemeriksaan lapangan. Kemudian menerbitkan keputusan penyelesaian sengketa apabila terbukti terdapat cacat administrasi. Selain itu memfasilitasi mediasi kepada pihak yang bersengketa. Hasil mediasi dibuat Perjanjian Perdamaian, Faktor penghambat dalam menyelesaikan sengketa pertanahan melalui mediasi di Kantor Pertanahan Kota Cilegon yakni pihak yang tidak beriktikad baik untuk memanfaatkan proses mediasi sebagai cara untuk mengulur-ulur waktu, pura-pura lupa atau ketidakjujuran dalam menyelesaikan sengketa. Rendahnya tingkat partisipasi pihak yang bersengketa dalam menyelesaikan sengketa tanah. Adanya alih teknologi dari sertifikat analog ke sertifikat elektronik. | |||||||||
