Abstract
Buying and selling is an agreement in which the party that binds himself to hand over an object and the other party to pay the price that has been promised. Dasih, as the seller, felt that what he was doing before the Notary was a debt agreement because Dasih had a debt to Niko Riyanto as the buyer. In paying for the sale and purchase of the land, he actually used the money Dasih owed to Niko Riyanto, which according to Niko Riyanto's confession amounted to Rp. 20,000,000 (twenty million rupiah) whereas according to Dasih's confession he only borrowed Rp. 5,000,000 (five million rupiah), if it is true that you have lent Rp. 20,000,000, which is actually nominal, is not eligible for the NJOP for that year. Defendant Kusno's witness statement stated that he was going to pay Dasih's debt to Niko Riyanto amounting to Rp. 5,000,000 (five million rupiah), but Niko Riyanto didn't want to accept it and said he didn't need to think about it because Dasih's children were still small, considering that Niko Riyanto was a place where people borrowed money at interest and Dasih was an economically and socially weak person. . So at the cassation level, Supreme Court Judge Dr. Pri Pambudi Teguh, S.H., M.H. expressed a difference of opinion (Dissenting Opinion) and stated that based on justice and imbalance between the Plaintiff and the Defendant it must be returned by stating that what occurred was a debt and not a sale and purchase of land. This research aims to analyze the legality of land sale and purchase transactions that occurred in Cassation Decision Number 628K/PDT/2020. The method used is normative legal research with statutory, conceptual and case approaches. The data source comes from secondary data consisting of primary materials, secondary materials and tertiary materials. Data collection techniques were carried out using library research. Data analysis was carried out using qualitative analysis which is descriptive analysis

Additional Information: | Jual beli adalah suatu persetujuan dengan mana pihak yang mengikatkan dirinya untuk menyerahkan suatu kebendaan dan pihak yang lain untuk membayar harga yang telah dijanjikan. Dasih sebagai pihak penjual merasa yang dilakukannya dihadapan Notaris adalah perjanjian hutang piutang karena memang Dasih mempunyai hutang kepada Niko Riyanto sebagai pihak pembeli, dalam pembayaran jual beli tanah tersebut sebenarnya menggunakan uang hutang Dasih ke Niko Riyanto yang menurut pengakuan Niko Riyanto sebesar Rp. 20.000.000 (dua puluh juta rupiah) sedangkan menurut pengakuan Dasih hanya meminjam uang sebesar Rp. 5.000.000 (lima juta rupiah), jika benar memang telah meminjamkan uang Rp. 20.000.000 yang sebenarnya nominal tersebut tidak layak dalam NJOP pada tahun tersebut. Keterangan saksi Tergugat Kusno mengatakan bahwa pernah akan membayar hutang Dasih kepada Niko Riyanto sebesar Rp. 5.000.000 (lima juta rupiah), tetapi Niko Riyanto tidak mau menerima dan mengatakan tidak usah dipikirkan karena anak Dasih masih kecil-kecil, mengingat bahwa Niko Riyanto adalah tempat orang meminjam uang yang dikenai bunga dan Dasih adalah orang yang lemah secara ekonomi dan sosial. Sehingga pada tingkat kasasi Hakim Agung Dr. Pri Pambudi Teguh, S.H., M.H. menyatakan beda pendapat (Dissenting Opinion) dan menyatakan berdasarkan keadilan dan ketidakseimbangan antara Penggugat dan Tergugat harus dikembalikan dengan menyatakan bahwa yang terjadi adalah hutang piutang dan bukan jual beli atas tanah. Penelitian ini bertujuan untuk menganalisis tentang Keabsahan dalam transaksi jual beli atas tanah yang terjadi dalam Putusan Kasasi Nomor 628K/PDT/2020. Metode yang digunakan yaitu penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual dan kasus. Sumber data berasal dari data sekunder terdiri dari bahan primer, bahan sekunder dan bahan tersier. Teknik pengumpulan data dilakukan dengan studi pustaka. Analisa data dilakukan dengan analisis kualitatif yang bersifat deskriptif analisis. | |||||||||
