Abstract
Dumping is the activity of disposing into certain environmental media. The act of dumping carried out by the MT Arman 114 Tanker in the Indonesian Exclusive Economic Zone causes sea water to be polluted. Dumping activities are regulated by UNCLOS 1982 as well as the Environmental Law and Law Number 5 of 1983 concerning the EEZ also regulates that these activities may only be carried out if they obtain permission from the Indonesian government. The problems in this discussion are How is the regulation of dumping committed by foreign vessels in Indonesia's exclusive economic zone based on UNCLOS 1982? How is the form of sanctions that can be imposed on the tanker MT Arman 114 that has committed dumping in the exclusive economic zone of Indonesia? This research uses the theory of law enforcement and the theory of absolute responsibility. This research uses normative juridical research methods supported by secondary data sources, data collection techniques are carried out by literature study and then analyzed qualitatively to get a detailed picture of the legal problems that occur. The results of this study are UNCLOS 1982 states that each country is obliged to provide adequate legislation in an effort to protect the marine environment. Then the Indonesian National Law has regulated dumping actions that can be carried out when obtaining Indonesian approval. Second, the MT Arman 114 Tanker has violated the provisions of the Environmental Law and the EEZ Law as demanded by the Batam District Court public prosecutor because it has committed an offense by dumping without a permit which resulted in marine pollution around the ship so that the MT Arman 114 can be subject to sanctions as stated in the Environmental Law because it has committed an act of dumping without a permit in the EEZ Area

| Additional Information: | Dumping adalah kegiatan pembuangan limbah ke area lingkungan hidup. Tindakan dumping yang dilakukan oleh Kapal Tanker MT Arman 114 di Kawasan Zona Ekonomi Eksklusif Indonesia menyebabkan air laut tercemar. Kegiatan dumping diatur oleh UNCLOS 1982 serta UU PPLH dan UU Nomor 5 Tahun 1983 tentang ZEEI turut mengatur kegiatan tersebut hanya boleh dilakukan jika memperoleh izin dari pemerintah Indonesia. Adapaun permasalahan dalam pembahasan ini ialah Bagaimana pengaturan tindakan dumping yang dilakukan oleh kapal asing di Kawasan zona ekonomi eksklusif Indonesia berdasarkan UNCLOS 1982? Bagaimana bentuk sanksi yang dapat dikenakan pada kapal tanker MT Arman 114 yang telah melakukan tindakan dumping di Kawasan zona ekonomi eksklusif Indonesia? Penelitian ini menggunakan teori Penegakan hukum serta teori tanggung jawab mutlak. Penelitian ini menggunakan metode penelitian yuridis normatif yang didukung oleh sumber data sekunder, Teknik pengumpulan data dilakukan dengan studi kepustakaan untuk kemudian dianalisis secara kualitatif untuk mendapatkan gambaran rinci mengenai permasalahan yang hukum yang terjadi. Adapun hasil penelitian ini adalah UNCLOS 1982 menyatakan setiap negara wajib menyediakan perundang-undangan yang memadai dalam upaya perlindungan lingkungan laut. Kemudian Hukum Nasional Indonesia telah mengatur mengenai tindakan dumping yang dapat dilakukan bila memperoleh persetujuan Indonesia. Kedua, Kapal Tanker MT Arman 114 telah melanggar ketentuan UU PPLH serta UU ZEEI sebagaimana tuntutan jaksa penuntut umum PN Batam karena telah melakukan tindakan pelanggaran dengan melakukan dumping tanpa izin yang mengakibatkan terjadinya pencemaran laut di sekitar kapal sehingga MT Arman 114 dapat dikenakan sanksi sebagaimana yang tercantum dalam UU PPLH karena telah melakukan tindakan dumping tanpa izin di Kawasan ZEEI. | |||||||||
