Abstract
Diplomatic representatives and their families are given immunity and privileges when carrying out their duties in the sending country so that the diplomatic mission being carried out can run smoothly. On December 8, 2022, Anne Sacoolas, the wife of a United States diplomatic official was sentenced to 8 months imprisonment replaced by 12 months probation and a 12-month driving ban by the British High Court. The purpose of this research is to find out the regulation of immunity rights of diplomat family members in the recipient country, as well as how the implementation of the 1961 Vienna Convention on Diplomatic Relations as the legal basis for granting immunity rights in the Anne Sacoolas dispute. The theory used in this research is the Principle of Diplomatic Immunity and the Principle of Pacta Sunt Servanda. The research used normative juridical research methods, with data sources using secondary data. Data collection is done through literature study, which is then analyzed qualitatively. From this research, it can be concluded that Article 37 Paragraph 1 of the 1961 Vienna Convention on Diplomatic Relations recognizes and regulates the right of immunity and diplomatic privileges to the family of diplomats, including the right of immunity to criminal, civil and administrative jurisdiction in the receiving country. Then, the UK's actions in this dispute, namely bringing the case to court and sentencing the family members of diplomat Anne Sacoolas, are not in accordance with the contents of the 1961 Vienna Convention on Diplomatic Relations which states that Family Members of Diplomatic Officials cannot be sentenced to criminal penalties and is a violation of the principle of Pacta Sunt Servanda. Pada 8 Desember 2022, Anne Sacoolas, istri seorang pejabat diplomatik Amerika Serikat dijatuhi hukuman penjara 8 bulan diganti dengan hukuman percobaan selama 12 bulan serta larangan mengemudi selama 12 bulan oleh Pengadilan Tinggi Inggris. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana pengaturan sengketa hak imunitas anggota keluarga diplomat di negara penerima, serta bagaimana implementasi Konvensi Wina 1961 tentang Hubungan Diplomatik sebagai dasar hukum pemberian hak imunitas dalam sengketa Anne Sacoolas. Teori yang dipakai dalam penelitian ini merupakan Prinsip Kekebalan diplomatik serta Prinsip Pacta Sunt Servanda. Diteliti menggunakan metode penelitian yuridis normatif, dengan sumber data menggunakan data sekunder. Pengumpulan data dilakukan melalui studi kepustakaan, yang kemudian dianalisis secara kualitatif. Dari penelitian ini dapat disimpulkan bahwa Pasal 37 Ayat 1 Konvensi Wina 1961 tentang Hubungan Diplomatik mengakui dan mengatur hak imunitas dan keistimewaan diplomatik kepada keluarga diplomat, termasuk hak imunitas terhadap yurisdiksi kriminal, sipil, maupun administratif di negara penerima. Kemudian, tindakan Inggris dalam sengketa ini, yaitu membawa kasus ini ke ranah pengadilan serta menjatuhkan hukuman terhadap anggota keluarga diplomat Anne Sacoolas, tidak sesuai dengan isi dari Konvensi Wina 1961 Tentang Hubungan Diplomatik yang menyatakan bahwa Anggota Keluarga Pejabat Diplomatik tidak dapat dijatuhi hukuman pidana serta merupakan pelanggaran terhadap prinsip Pacta Sunt Servanda.
