Abstract

Child Trafficking is one of the crimes classified under human trafficking, with the aim of sexual exploitation, but it also encompasses other forms of exploitation such as forced labor, slavery, and slavery-like practices. The modus operandi often involves minors employed in various professions such as prostitution and pornography, begging, domestic work, drug trafficking, and other exploitative jobs, including migrant labor involving international networks. Therefore, child victims are entitled to all protections and rights as provided by legislation, including ef orts for medical and social rehabilitation, both institutional and non-institutional, as well as safety guarantees encompassing physical, mental, and social aspects. Legal protection may include restitution to compensate forvictims' financial losses, suffering, and reimbursement of medical and/or psychological treatment costs. This study examines judicial considerations inrejecting restitution for child victims of child trafficking crimes, and assesses thelegal protections provided for them. The theories utilized are judicial consideration theory and victim protection theory, employing a normative juridical research method that analyzes the District Court Decision No. 27/Pid.Sus/2019/PN.Kpg. The research specification is descriptive-analytical, using secondary data sources. The research findings indicate that the judicial considerations in Decision No. 27/Pid.Sus/2019/PN.Kpg. did not adequately prioritize the interests of the child victims, resulting in the rejection of their restitution request by the panel of judges. Therefore, there is a need for a service model as a reference in providing legal protection in the form of restitutionforchild victims, ensuring their complete physical, psychological, and social recovery, and uninterrupted growth and development despite having been victimsof criminal acts.

Additional Information: Tindak Pidana Perdagangan Anak (Child TrafFicking) merupakan salah satu tindak pidana yang termasuk perdagangan orang, dengan tujuan untuk eksploitasi seksual, tetapi mencakup bentuk eksploitasi lain seperti kerja paksa, perbudakan dan praktik serupa perbudakan. Modus operandi, anak dibawah umur yang sering dipekerjakan dalam berbagai profesi seperti dalam bisnis pelacuran dan pornografi, pengemis, pembantu rumah tangga, dimanfaatkan dalam perdagangan narkoba, pekerjaan lain yang bersifat eksplotasif, termasuk pekerja migran yang melibatkan jaringan antar negara. Maka anak korban berhak atas semua perlindungan dan hak yang diatur dalam ketentuan perundang-undangan, meliputi upaya rehabilitasi medis dan sosial, baik dalam lembaga maupun di luar lembaga, serta Jaminan keselamatan, baik fisik, mental, maupun sosial. Perlindungan hukum tersebut dapat berupa restitusi yang mengganti kerugian korban kekayaan, penderitaan, serta pergantian biaya perawatan medis dan/atau psikologis. Penelitian ini mengkaji pertimbangan hakim dalam menolak restitusi bagi anak korban tindak pidana perdagangan anak, dan mengkaji perlindungan hukum yang diberikan bagi anak korban tindak pidana perdagangan anak. Teori yang digunakan adalah teori pertimbangan hakim dan teori perlindungan korban, dengan jenis penelitian yuridis normatif yang mengkaji Putusan Pengadilan Negeri Kupang Nomor 27/Pid.Sus/2019/PN.Kpg. Spesifikasi penelitan berupa deskriptif analitis dan sumber data berupa data sekunder. Hasil penelitian menunjukan bahwa pertimbangan hakim dalam Putusan No. 27/Pid.Sus/2019/PN.Kpg kurang memperhatikan kepentingan anak korban sehingga permohonan restitusi sebagai bentuk perlindungan hukum bagi anak korban ditolak oleh Majelis Hakim. Kemudian diperlukan adanya model pelayanan (the service model) sebagai acuan dalam memberikan perlindungan hukum yang berupa restitusi bagi anak korban, sehingga pemulihan anak korban baik secara fisik, psikologis, dan sosial terpenuhi secara lengkap serta tumbuh kembang anak tidak terganggukarena pernah menjadi korban tindak pidana.
