Abstract
The crime of investment fraud as contained in chapter XXV book II of the Criminal Code from Article 378 to article 395. Article 378 refers to committing acts, namely carrying out tricks and deception or lying words or persuading other people or fraudulent acts, using a false name or false circumstances, encouraging people to give goods or give debts or write off receivables with a maximum prison sentence of 4 years. This research discusses the criminal sanctions for fraud motivated by investment of money according to the Criminal Code and how to overcome the crime of fraud motivated by investment in Serang City, the theory used is the theory of punishment and the theory of crime prevention. This research uses a normative legal research method with a descriptive approach and uses a qualitative analysis method. The results of this research are criminal sanctions for money investment-motivated fraud according to the Criminal Code as stipulated in Article 378 of the Criminal Code, namely a maximum prison sentence of 4 years, and to minimize victims of investment-motivated fraud in the community, the police should always provide education to the public. both in person and online.

| Additional Information: | Kejahatan penipuan investasi sebagaimana yang dimuat dalam bab XXV buku II KUHP dari Pasal 378 s/d pasal 395. Pasal 378 tersebut dimaksud melakukan perbuatan yaitu melakukan akal dan tipu muslihat atau perkataan-perkataan bohong atau membujuk orang lain atau perbuatan curang, memakai nama palsu atau keadaan palsu, menggerakkan orang untuk memberikan suatu barang atau memberi hutang atau menghapus piutang dengan pidana penjara paling lama 4 tahun. Penelitian ini membahas tentang Bagaimana Sanksi pidana terhadap penipuan bermotif Investasi uang menurut Kitab Undang-Undang Hukum Pidana dan Bagaimana upaya penanggulangan kejahatan penipuan bermotif investasi uang di Kota Serang, teori yang digunakan teori pemidanaan dan teori penanggulangan kejahatan. Penelitian ini menggunakan metode Penulisan hukum normative dengan Pendekatan deskriptif serta menggunakan metode analisis kualitatif. Hasil dari penelitian ini adalah Sanksi Pidana Terhadap Penipuan Bermotif Investasi Uang Menurut Kitab Undang-Undang Hukum Pidana sebagaimana ditetapkan dalam pasal 378 KUHP yaitu pidana penjara paling lama 4 tahun, dan Untuk meminimalisir korban penipuan bermotif investasi di masyarakat hendaknya pihak kepolisian selalu memberikan penyuluhan kepada masyarakat baik secara langsung maupun secara online. | |||||||||
