Abstract
The implementation of the death penalty for persons with disabilities as perpetrators of serious crimes is not specifically regulated, but according to international customs this clearly violates Article 3 of the Universal Declaration of Human Rights (UDHR) and violates the rights of persons with disabilities as stated in the Convention on the Rights of Persons with Disabilities (CRPD) as a legal umbrella that explains the provisions, all regulations and rights related to people with disabilities. There are two problems that arise, namely, what are the rights of people with intellectual disabilities who are perpetrators of serious crimes regarding the implementation of the death penalty according to the Convention on the Rights of Persons with Disabilities (CRPD)? and Is the provision of the death penalty for Nagaenthran K. Darmalingam as a perpetrator of serious crimes in Singapore in accordance with the Convention on the Rights of Persons with Disabilities (CRPD) concerning the protection of the rights of persons with disabilities? Protection theory and law enforcement theory are the basic theories that the author will use in explaining the appropriateness of applying the death penalty to people with disabilities, especially intellectual disabilities, in this case. The method used is a normative juridical research method as a supporting reference. The results of this research are: First, the lack of regulation in the CRPD causes violations of the rights of persons with disabilities, especially as defendants, so that arbitrary detention often occurs. Second, the Singapore government's inappropriate implementation of the death penalty against Nagaentran K. Dharmalingam as a person with intellectual disabilities has violated the rights of persons with disabilities as stated in the CRPD and UDHR. The ineffectiveness of the contents of the convention is the reason that the CRPD and UDHR are not effective in becoming a reference for granting rights to people with disabilities, especially intellectual disabilities, as in the case of Nagaenthran K. Dharmalingam in Singapore.

Terdapat dua masalah yang muncul yaitu, Bagaimana bentuk hak-hak penyandang disabilitas intelektual pelaku kejahatan berat terhadap pelaksanaan hukuman mati menurut Convention on the Rights of Person with Disabilities (CRPD)? dan Apakah pengaturan hukuman mati terhadap Nagaenthran K. Darmalingam sebagai pelaku kejahatan berat di Singapura sudah sesuai dengan Convention on the Right of Person with Disabilities (CRPD) tentang perlindungan hak-hak bagi penyandang disabilitas? Teori perlindungan dan teori penegakan hukum menjadi teori dasar yang akan penulis gunakan dalam menjelaskan kesesuaian penerapan hukuman mati kepada penyandang disabilitas khususnya disabilitas intelektual dalam kasus ini. Metode yang digunakan merupakan metode penelitian yuridis normatif sebagai referensi pendukung. Hasil dari penelitian ini adalah: Pertama, Kurangnya pengaturan dalam CRPD menyebabkan terjadi pelanggaran terhadap hak-hak penyandang disabilitas khususnya sebagai terdakwa sehingga sering terjadi penyalahan penahanan sewenang-wenang. Kedua, Ketidaksesuaian pelaksanaan hukuman mati terhadap Nagaentran K. Dharmalingam sebagai penyandang disabilitas intelektual oleh pemerintah Singapura telah melanggar hak-hak penyandang disabilitas yang tercantum dalam CRPD dan UDHR. Tidak efektifnya isi konvensi tersebut menjadi alasan bahwa CRPD dan UDHR tidak efektif dalam menjadi acuan pemberian hak-hak terhadap para penyandang disabilitas khususnya disabilitas intelektual seperti pada kasus Nagaenthran K.
