Abstract

The role of financial institutions, banks, non-banks, and even credit institutions is to help people who are left behind follow developments in economic development by establishing financial institutions. PT. Pegadaian is a company designated to receive and distribute credit based on pawn law in Indonesia and is an institution that facilitates the public to obtain cash loans that are practically easy for every prospective customer to obtain and is an institution appointed to receive and distribute credit based on pawn law in Indonesia. There was damage to the rear bumper of the car which was a pawned item belonging to a PT customer. Pegadaian CP Sudirman, was only discovered by the owner of the item when the customer paid off the loan and handed over the customer's vehicle to Pegadaian. The research method used is library study and field research methods. The types of data for this research are primary data and secondary data and are arranged systematically and to examine secondary data using an empirical juridical approach and analyzed qualitatively. The research results show that the form of responsibility and consumer protection for Pegadaian customers due to damage to pawned goods is contained in POJK Number 31/POJK.05/2016 concerning Pawnshop Businesses article 25 and Directors Regulation Number 98/DIR I/2017 concerning Guidelines for Compensation for Collateralized Goods. There is a claim for compensation due to damage to the customer's pawned goods, which occurred due to the pawn holder's negligence in storing the customer's collateral at PT. Pawnshop. Claims for compensation will be given after the customer has paid off his debt by paying the compensation value, resulting in the cancellation of the pawn agreement.

Additional Information: Peran lembaga keuangan, bank, non-bank, bahkan lembaga perkreditan turut serta membantu masyarakat yang tertinggal mengikuti perkembangan di dalam pembangunan ekonomi dengan mendirikan lembaga keuangan. PT. Pegadaian merupakan suatu yang ditunjuk untuk menerima dan menyalurkan kredit berdasarkan hukum gadai di Indonesia dan merupakan lembaga yang memfasilitasi masyarakat untuk memperoleh pinjaman uang secara praktis mudah di dapatkan oleh setiap calon nasabah dan merupakan lembaga yang ditunjuk untuk menerima dan menyalurkan kredit berdasarkan hukum gadai di Indonesia. Tejadinya kerusakan bumper bagian belakang mobil yang merupakan barang gadai milik nasabah PT. Pegadaian CP Sudirman, baru diketahui oleh pemilik barang tersebut pada saat nasabah melunasi uang pinjamannya dan melakukan penyerahan kendaraan milik nasabah dengan pihak Pegadaian. Metode penelitian yang digunakan adalah menggunakan metode studi pustaka dan penelitian lapangan. Jenis data penelitian ini adalah data primer dan data sekunder dan disusun secara sistematis dan untuk mentelaah data-data sekunder menggunakan pendekatan yuridis empiris dan dianalisis secara kualitatif. Hasil penelitian menunjukan bahwa bentuk tanggung jawab dan perlindungan konsumen nasabah Pegadaian akibat kerusakan barang gadai terdapat pada POJK Nomor 31/POJK.05/2016 Tentang Usaha Pergadaian pasal 25 dan Peraturan Direksi Nomor 98/DIR I/2017 tentang Pedoman Ganti Rugi Barang Jaminan. Adanya tuntutan ganti rugi akibat kerusakan barang gadai milik nasabah, yang terjadi karena kelalaian pemegang gadai dalam penyimpanan barang jaminan milik nasabah di PT. Pegadaian. Tuntutan ganti rugi akan diberikan setelah nasabah melunasi hutangnya dengan pembayaran nilai ganti rugi maka mengakibatkan hapusnya perjanjian gadai.
