Abstract

The Constitutional Court recently ruled on the results of the Judicial Review of Law Number 11 of 2020 concerning Job Creation. For the first time since its establishment, the Constitutional Court has partially granted a formal test application. The Panel of Constitutional Judges emphasized that Law Number 11 of 2020 on Job Creation is formally flawed. The Court stated that the Job Creation Law is Conditionally Unconstitutional. Problem Identification in this study are: what is the basis for the legal considerations of the Constitutional Court in Decision Number 91 / PUU-XVIII / 2020 which states that Law Number 11 of 2020 concerning Job Creation is considered Formally Defective and what is the position of the Job Creation Law after the enactment of Law Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Formation of Legislation. This research uses normative juridical methods with qualitative research types. The type of data used is secondary data with literature study data collection techniques. Which is analyzed normatively qualitative. Based on the results of the study, it can be seen that: The Job Creation Law is considered Formally Defective and declared Conditionally Unconstitutional by the Constitutional Court based on incompatibility with the 1945 Constitution and Law Number 12 of 2011 concerning the Formation of Legislation. The Copyright Law will continue to apply with the enactment of Law Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Formation of Legislation. In making a law, ideally it should be done in synchronization and harmonization so that it is in line with the formal-material aspects of Law Number 12 of 2011 and in accordance with the noble values of Pancasila.

Additional Information: Mahkamah Konstitusi beberapa waktu lalu baru saja memutus hasil Judicial Review terhadap Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Pertama kalinya sejak berdiri, Mahkamah Konstitusi mengabulkan untuk sebagian permohonan uji formil. Majelis Hakim Konstitusi menegaskan bahwa Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja cacat secara formil. Mahkamah menyatakan bahwa Undang-Undang Cipta Kerja Inkonstitusional Bersyarat. Identifikasi Masalah dalam penelitian ini yaitu: apa yang menjadi dasar pertimbangan hukum Mahkamah Konstitusi dalam Putusan Nomor 91/PUU-XVIII/2020 yang menyatakan bahwa Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dinilai Cacat Formil dan Bagaimanakah kedudukan Undang-Undang Cipta Kerja Pasca diundangkannya Undang-Undang Nomor 13 Tahun 2022 tentang Perubahan Kedua atas Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Penelitian ini menggunakan metode yuridis normatif dengan jenis penelitian Kualitatif. Jenis data yang digunakan adalah data sekunder dengan teknik pengumpulan data studi pustaka. Yang dianalisis secara normative kualitatif. Berdasarkan hasil penelitian dapat diketahui bahwa: Undang-Undang Cipta Kerja dinilai Cacat Formil dan dinyatakan Inkonstitusional Bersyarat oleh Mahkamah Konstitusi didasarkan pada ketidaksesuaian terhadap Undang-Undang Dasar 1945 dan Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Undang-Undang Cipta akan terus berlaku dengan diundangkannya Undang-Undang Nomor 13 Tahun 2022 tentang Perubahan Kedua atas Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Dalam pembuatan suatu undang-undang idealnya harus dilakukan dengan sinkron dan harmonisasi agar sejalan dengan aspek formil-materiil Undang-Undang Nomor 12 Tahun 2011 dan sesuai kaidah nilai luhur Pancasila.
