Abstract

The Indonesian Ombudsman reported that throughout 2023 there were 8,458 public reports regarding public services. This auxiliary agency was given the authority to supervise and provide recommendations to public service providers who carried out maladministration, but many of the Ombudsman's recommendations were not followed up. Identification of problems, how is the implementation of Ombudsman Recommendation Number 0002/RM.03.01/0750.2017/XII/2022 towards parties in public service providers?, what are the reasons for not implementing Recommendation Number 0002/RM.03.01/0750.2017/XII/2022? State organ/institution theory and supervision theory are used. Empirical juridical research methods, data collection techniques, field research and literature. The results of the research, Article 38 paragraph (1) of the Ombudsman Law states that the reported party and the reported superior are obliged to implement the Ombudsman's Recommendations, the supervision carried out by the Ombudsman in this case was ordered to be repressive supervision which began with an FWI report regarding maladministrative actions carried out by the PPID of the Ministry of ATR/BPN. The conclusion of this research is that the PPID of the Ministry of ATR/BPN has suggested implementing the Recommendation in part by sending a letter to the reporter, in essence the requested information can be accessed at web:bhumi/bpn.go.id. The reason PPID of the Ministry of ATR/BPN did not implement these recommendations was that it caused losses such as business competition, apart from that there were regulatory conflicts and in this case a second PK was still being sought by the Ministry of ATR/BPN. Suggestion: The Ombudsman must be more assertive in completing reports, state institutions in making regulations need to synchronize related regulations, the PPID of the ATR/BPN ministry provides information that is relevant to the needs of the community.

Additional Information: Ombudsman RI melaporakan sepanjang tahun 2023 terdapat 8.458 laporan masyarakat trkait pelayanan publik, lembaga auxiliary ini diberikan kewenangan untuk melakukan pengawasan dan memberikan Rekomendasi kepada penyelenggara pelayanan publik yang melakukan maladministrasi namun banyak Rekomendasi Ombudsman tidak ditindaklanjuti. Identifikasi masalah, bagaimana implementasi Rekomendasi Ombudsman Nomor 0002/RM.03.01/0750.2017/XII/2022 terhadap para pihak dalam penyelenggara pelayanan publik?, apa penyebab belum dilaksanakannya Rekomendasi Nomor 0002/RM.03.01/0750.2017/XII/2022?, teori yang digunakan teori organ/lembaga negara dan teori pengawasan. Metode penelitian yuridis empiris, teknik pengumppulan data, penelitian lapangan dan kepustakaan. Hasil penelitian, Pasal 38 ayat (1) Undang-Undang Ombudsman bahwa terlapor dan atasan terlapor wajib melaksanakan Rekomendasi Ombudsman, pengawasan yang dilakukan Ombudsman terhadap kasus ini dikategorikan pengawasan represif dimana diawali dengan adanya laporan FWI atas tindakan maladministrasi yang dilakukan oleh PPID Kementerian ATR/BPN. Kesimpulan penelitian ini, PPID Kementerian ATR/BPN telah dikategorikan melaksanakan Rekomendasi sebagian dengan menyampaikan surat kepada pelapor yang pada pokoknya terhadap permohonan informasi yang dimohonkan dapat diakses pada web:bhumi/bpn.go.id. penyebab PPID Kementerian ATR/BPN tidak melaksanakan Rekoemndasi tersebut adalah dikhawatirkan menimbulkan kerugian seperti persaingan bisnis selain itu terdapat benturan peraturan dan pada kasus ini masih diupayakan PK kedua kalinya oleh Kementerian ATR/BPN. Saran: Ombudsman harus lebih tegas dalam penyelesaian laporan, lembaga negara dalam membuat aturan perlu sinkronisasi peraturan terkait, PPID kementerian ATR/BPN memberikan informasi yang relevan dengan kebutuhan publik.
