Abstract
This research discusses the policy of the obligation to increase the use of domestic products in government procurement of goods/services as stated in Article 86 of Law Number 3 of 2014 concerning Industry. The obligation to use domestic products is carried out if there is a domestic product that has the sum of the Domestic Component Level (TKDN) value plus the Company Benefit Weight (BMP) value of at least 40% (forty percent). This obligation must be carried out by the Government Procurement of Goods/Services. On the other hand, it is not uncommon for the types of goods required not to meet the TKDN provisions. This research aims to answer 2 (two) identified problems, namely: (1) What is the scope of responsibility of actors procuring government goods/services? (2) What is the form of accountability of actors procuring government goods/services regarding compliance with domestic component levels? This research uses normative juridical and empirical juridical methods with a statutory approach and case approach and qualitative juridical data analysis techniques are used. The results of the research show that, Firstly, the position of procurement actor in positive constitutional law is attached to duties and authority which are mobilized through the intermediary of officials, it is the official's attitude that forms the content of his obligations, he is required to be held accountable for his official actions in state institutions, even though this responsibility represents his position. Second, the form of responsibility of actors procuring goods/services for compliance with domestic component levels is based on civil and administrative accountability. In civil and administrative terms, procurement actors cannot be sued for compensation for costs/expenses for procurement that does not have TKDN. This is because the formulation of articles 86-87 of Law Number 3 of 2014 concerning Industry, if applied to real conditions in certain sectors which require specific specifications of goods/services, is unable to achieve the legal provisions in the form of the quantity of domestic components in each good/service. This is based on availability or not enough. Procurement actors can only be held accountable in the form of administrative sanctions.

Additional Information: | Penelitian ini membahas mengenai kebijakan Kewajiban peningkatan penggunaan produk dalam negeri pada pengadaan barang/jasa pemerintah sebagaimana tertuang pada Pasal 86 Undang-undang Nomor 3 Tahun 2014 tentang Perindustrian. Kewajiban penggunaan produk dalam negeri dilakukan apabila terdapat produk dalam negeri yang memiliki penjumlahan nilai Tingkat Komponen Dalam Negeri (TKDN) ditambah nilai Bobot Manfaat Perusahaan (BMP) paling sedikit 40% (empat puluh persen). Kewajiban tersebut harus dilakukan oleh Pelaku Pengadaan Barang/Jasa Pemerintah. Di sisi lain, tidak jarang dibutuhkan jenis barang yang dibutuhkan tidak memenuhi ketentuan TKDN tersebut. Penelitian ini ingin menjawab 2 (dua) identifikasi masalah yaitu: (1) Bagaimana ruang lingkup tanggungjawab Pelaku pengadaan barang/jasa pemerintah? (2) Bagaimana bentuk pertanggungjawaban Pelaku pengadaan barang/jasa pemerintah terhadap pemenuhan tingkat komponen dalam negeri? Penelitian ini menggunakan metode yuridis normatif dan yuridis empiris dengan pendekatan perundang-undangan (statute approach) dan kasus (case approach) dan teknik analisis data yang digunakan yuridis kualitatif. Hasil penelitian menunjukkan bahwa, Pertama jabatan pelaku pengadaan dalam hukum tata negara postif melekat tugas dan wewenang yang digerakkan melalui perantaraan pejabat, sikap pejabatlah yang membentuk isi dari kewajiban kepadanya dituntut pertanggungjawaban atas tindakan jabatan dalam lembaga negara walaupun pertanggungjawaban tersebut mewakili jabatannya. Kedua, bentuk pertanggungjawaban pelaku pengadaan barang/jasa terhadap pemenuhan tingkat komponen dalam negeri didasarkan pada pertanggungjawaban perdata dan administrasi. Secara perdata maupun administrasi pelaku pengadaan tidak dapat dituntut ganti kerugian biaya/beban atas pengadaan yang tidak ber TKDN. Dikarenakan rumusan pasal 86-87 Undang-undang Nomor 3 tahun 2014 tentang Perindustrian jika diterapkan pada kondisi nyata pada sektor tertentu yang membutuhkan kekhususan spesifikasi barang/jasa tidak mampu mencapai ketentuan hukum tersebut berupa besaran komponen dalam negeri pada setiap barang/jasa. Hal ini didasarkan pada ketersediaan atau belum mencukupi. Pelaku pengadaan hanya dapat dituntut pertanggungjawaban berupa sanksi administratif. | |||||||||
