Abstract
Beating is an act of openly and with joint force using violence against people who cause injuries and goods that cause damage to goods, as well as violence that eliminates the lives of others or results in death (Article 170 of the Criminal Code). The crime of beating committed by football supporters against other football supporters shows that football in Indonesia is not professional and unsafe and causes unrest in the community. The beating committed by soccer supporters is of particular concern, considering that the consequences of violent acts committed cause fatalities. This study aims to determine the criminal responsibility for the perpetrators of beatings between soccer supporters and how law enforcement against soccer supporters who commit the crime of beating in the case of beating Persija Jakarta supporter Haringga Sirla, who was the victim of an act of beating to death by a number of unscrupulous Persib supporters on September 24, 2018 at the GBLA stadium, especially in decision number 9/Pid.B/2019/PN Bdg. The theories used are the Theory of Criminal Liability and the Theory of Law Enforcement. The research method used is qualitative research with a normative juridical approach. The data used is secondary data. Secondary data is data derived from library materials consisting of primary, secondary and tertiary legal materials. The results of the study concluded that the responsibility of the perpetrator of the crime of beating in decision number 9/Pid.B/2019/PN Bdg, the defendant was able to be responsible for his actions because he fulfilled all the elements in Article 170 paragraph (2) 3rd of the Criminal Code. However, the judge's decision was lower than the prosecutor's demand, namely imprisonment for 7 years, while the prosecutor's demand was imprisonment for 8 years.

| Additional Information: | Pengeroyokan merupakan tindakan dengan terang-terangan dan dengan tenaga bersama menggunakan kekerasan terhadap orang yang menyebabkan luka-luka dan barang yang menyebabkan perusakan barang, serta kekerasan yang menghilangkan nyawa orang lain atau mengakibatkan maut (Pasal 170 KUHP). Tindak pidana pengeroyokan yang dilakukan supporter sepak bola terhadap supporter sepak bola lain menunjukan bahwa sepak bola di Indonesia tidak professional dan tidak aman serta menimbulkan keresahan di masyarakat. Pengeroyokan yang dilakukan oleh supporter sepak bola menjadi perhatian khusus, mengingat konsekuensi tindakan kekerasan yang dilakukan menimbulkan korban jiwa. Penelitian ini bertujuan untuk mengetahui pertanggung jawaban pidana bagi pelaku pengeroyokan antar supporter sepak bola dan bagaimana penegakan hukum terhadap supporter sepak bola yang melakukan tindak pidana pengeroyokan pada kasus pengeroyokan suporter Persija Jakarta Haringga Sirla, yang menjadi korban dari tindakan pengeroyokan hingga meninggal dunia oleh sejumlah oknum supporter Persib pada 24 September 2018 di stadion GBLA, khususnya pada putusan nomor 9/Pid.B/2019/PN Bdg. Teori yang digunakan adalah Teori PertanggungjawabanPidana dan Teori Penegakan Hukum. Metode penelitian yang digunakan adalah penelitian kualitatif dengan metode pendekatan yuridis normatif. Data yang digunakan adalah data sekunder. Data sekunder merupakan data yang berasal dari bahan-bahan pustaka terdiri dari bahan hukum primer, sekunder dan tersier. Hasil penelitian menyimpulkan bahwa pertanggungjawaban pelaku tindak pidana pengeroyokan dalam putusan nomor 9/Pid.B/2019/PN Bdg, terdakwa mampu bertanggung jawab atas perbuatannya karena memenuhi semua unsur pada Pasal 170 ayat (2) ke-3 KUHP. Namun vonis Hakim lebih rendah dari pada tuntutan Penuntut Umum yakni pidana penjara selama 7 tahun, sedangkan tuntutan penuntut umum pidana penjara selama 8 tahun. | |||||||||
