Abstract

This article aims to explore the issue of the phenomenon of illegal mining in Lebak due to social injustice in mining policy. With that in mind, this paper looks at the perspective of the meaning of the illegal mining community in Lebak regarding the concept of social justice in mining policy. The theory used is John Rawls' social justice. The research method uses qualitative methods with a Creswell phenomenological approach. The results of the research show that: First, the meaning of mining in the illegal mining community of Lebak means income and employment due to economic needs to be able to make ends meet, low education factors, lack of skills or business capital, and small employment opportunities. Second, the meaning of social justice in the illegal mining community has not yet fully interpreted social justice as a mining community because policies do not support the small people, business permits are complicated, justice is only available to someone who has power and money, and there is no solution from the government. if mining activities are closed. Third, community mining policy shows that Minerba policy regulations do not favor the illegal mining community in Lebak and do not get maximum benefits from mining management because the legal principles of Minerba policy do not position the community. There is no equal opportunity in Rawls's principle of justice because policy regulations are interpreted as differentiating between classes of miners.

Additional Information:	Tulisan ini bertujuan mendalami persoalan mengenai fenomena pertambangan ilegal di Lebak karena adanya ketidakadilan sosial dalam kebijakan pertambangan. Dengan itu tulisan ini melihat perspektif pemaknaan dari masyarakat penambang ilegal di Lebak mengenai konsep keadilan sosial dalam kebijakan pertambangan. Teori yang digunakan adalah keadilan sosial John Rawls. Metode penelitian menggunakan metode kualitatif dengan pendekatan fenomenologi Creswell. Hasil penelitian menunjukkan bahwa: Pertama, pemaknaan pertambangan masyarakat penambang ilegal Lebak memaknai pendapatan dan pekerjaan karena adanya faktor kebutuhan ekonomi untuk dapat memenuhi hidup, faktor pendidikan rendah, tidak adanya modal keahlian maupun modal usaha, dan kecilnya lapangan pekerjaan. Kedua, pemaknaan keadilan sosial masyarakat penambangan ilegal belum memaknai keadilan sosial secara penuh sebagai masyarakat penambang karena kebijakan yang tidak berpihak pada rakyat kecil, izin usaha yang berbelit-belit, keadilan hanya dimiliki oleh seseorang yang memiliki kuasa dan uang, serta tidak adanya solusi dari pemerintah jika kegiatan pertambangan ditutup. Ketiga, kebijakan pertambangan masyarakat menunjukkan bahwa regulasi kebijakan Minerba tidak berpihak kepada masyarakat penambang ilegal di Lebak dan tidak mendapat manfaat yang maksimal atas pengelolaan pertambangan karena prinsip hukum kebijakan Minerba tidak memposisikan masyarakat. Tidak adanya kesempatan yang sama dalam prinsip keadilan Rawls karena peraturan kebijakan dimaknai membedakan kelas penambang.
