Abstract

This article aims to explain the phenomena that occur when providing unfair services in the field of BPJS Health services and to understand the concepts of the welfare state and social justice in providing BPJS Health services. The welfare state remains a crucial issue for every country. Public welfare is still questioned by the public regarding state administration. Thus, the issue of welfare and justice in the implementation of BPJS Health is addressed with assistance from key informants for the meaning of justice and prosperity. The article uses Jeremy Bentham's theory, which examines the concepts of the welfare state with a focus on welfare and happiness from the government. It employs qualitative research methods with a phenomenological approach from Cresswell, focusing on the meaning of justice and welfare based on the experiences of key informants who are BPJS users. The results of this research indicate that BPJS has entered the concept of the welfare state, but the facts on the ground tell a different story. People are still competing to achieve prosperity and happiness in Indonesia. The findings are as follows: First, there is still discrimination in people's access to health services. Second, there is a lack of equality in obtaining the right to health. Third, the community does not fully enjoy the right to health. Fourth, many people achieve happiness by force.

Additional Information:	Tulisan ini bertujuan untuk menjelaskan fenomena yang terjadi pada saat pemberian pelayanan yang tidak adil di bidang pelayanan BPJS Kesehatan; dan Memahami konsep negara kesejahteraan dan keadilan sosial dalam pemberian pelayanan BPJS Kesehatan. Negara kesejahteraan masi menjadi isu krusial oleh setiap negara. Kesejahteraan masi dipertanyakan masyarakat terhadap penyelenggaraan negara. Dengan demikian isu kesejahteraan dan keadilan dalam penyelenggaraan BPJS kesehatan dengan bantuan dari key informant untuk pemaknaan keadilan dan kesejahteraan. Tulisan menggunakan teori dari Jeremy Bentham yang mengkaji konsep welfare state dengan fokus kesejahteraan dan kebahagiaan hadirnya dari pemerintah. Menggunakan metode penelitian kualitatif dengan pendekatan fenomenologi dari Cresswell yang memfokuskan pemaknaan keadilan dan kesejahteraan berdasarkan pengalaman dari key informant pengguna BPJS. Hasil penelitian ini adalah bahwa BPJS telah masuk konsep welfare state tetapi fakta di lapangan berbicara lain, masyarakat masih belomba-lomba untuk mendapatkan kesejahteraan dan kebahagiaan di Indonesia. Faktanya menjawab bahwa: Pertama, masyarakat dalam mendapatkan kesehatan masih adanya diskriminasi. Kedua, ketidakadanya kesetaraan dalam mendapatkan hak kesehatan. Ketiga, hak kesehatan tidak didapat oleh masyarakat. Keempat banyak masyarakat mendapatkan kebahagiaan dengan cara nepotisme.
